From: Lambert, Tom, 1/Sgt.

Thank you for your recent email to the Virginia Department of State Police (the Department) seeking "[d]ocuments relating to any agreements, contracts or instances where the Department loaned out a cell site simulator (including StingRay, AmberJack, Hailstorm, Kingfish, Gossamer, Triggerfish, or DRTboxes) to another law enforcement department." As you may be aware, requests for records of the Commonwealth, its agencies and political subdivisions are governed by the Virginia Freedom of Information Act (FOIA), §§ 2.2-3700 et. seq. of the Code of Virginia. Under FOIA the Department is not required to answer questions or create documents that do not already exist.

Pursuant to Virginia Code § 2.2-3704(B)(3), the requested records could not be found or do not exist as the Department has never "loaned out a cell site simulator" to another law enforcement ageny.
