Pursuant to the Vermont Public Records Act, I hereby request the following records:

The Vermont National Guard's progress report to the governor and legislature detailing human resource policies and procedures. This report was requested by the governor, which was scheduled to be submitted on May 1. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Afternoon Jasper

Attached please find the Guard report and responses to the Governor's follow-up questions. To be clear, this final report was received by the Governor's Office on February 21, 2020. As you know, the COVID 19 pandemic consumed a significant amount of the time and the resources of both the Governor and the Vermont National Guard since February, so it took us some additional time to release to you.

In response to the Governor's follow up questions, the Guard took the time needed to conduct an internal review over several months to address and respond, and to make sure the Governor has a clear picture of the "before" and the "after" regarding the policy changes.

As a reminder, the report from General Knight is advisory to the Governor for policy and decision-making purposes and as a matter of public records law, it is subject to executive privilege and therefore is not required to be released. However, as we've said, in the interest of transparency he agreed to share the final report once complete and he had received all the additional information he requested.

We would also like to refute the timeline you've described below and your use of your initial and separate May 3, 2019 request as the "original request date" for these documents.

On May 3, 2019, you requested "the Vermont National Guard's progress report to the governor and the legislature detailing human resource policies and procedures." This report was requested by the Governor, which was scheduled to be submitted on May 1. We responded to your request on May 10 with the National Guard policy review response letter to the Governor dated May 1, 2019 outlining the current ongoing policy review status with a more comprehensive report to follow September 30, 2019. This response fulfilled your original May 3, 2019 request.

On September 27, 2019, you made a new request for the National Guard's comprehensive report referenced in the May 1, 2019 letter. You were advised that the report was not due until September 30, 2019. Since that time, Rebecca Kelley and I have repeatedly advised you on the delivery and status of the review process, which included requests for additional information from the Guard (meaning the report was not yet complete). In the interim, on January 2, 2020, we offered to provide you with the Governor's memo requesting more information. You responded on January 27, 2020 confirming you wanted that document, which was then provided to you.

And as noted above, all supplementary materials were then received from the Guard on February 21, 2020.
