Pursuant to the Vermont Public Records Act, I hereby request the following records:
Copies of all reports of use of force within all prisons in the state, dated between March 1, 2020 and the date this request is processed.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Ms. Rock,
The Vermont Department of Corrections has received your request for records.
1. Copies of all reports of use of force within all prisons in the state, dated between March 1, 2020 and the date this request is processed.
a. These records are part of an Inmate record. Inmate records are designated confidential pursuant to 28 V.S.A § 107(b), and are not subject to public disclosure under 1 V.S.A. § 317(c)(1). Statistical reports on use of force within the parameters of your request are available.
Provisions of the law 1 V.S.A § 316 (b)(c), allow for the charging and collection of costs to produce these records. There has been a cost associated with your request as outlined below.
90 minutes @ $0.45 per minute(no charge for first 30 minutes) = $40.50
80 copies @ $0.05 per page = $4.00
$ 44.50
Therefore, I request that you send a check in that amount payable to the Department of Corrections, NOB 2 South 280 State Drive, Waterbury, VT 05671-2000. Please send to the attention of the Business Office and reference request #38440. Once payment has been received the documents will be sent.
Since this letter is a partial denial of your request you should be aware that this denial may be appealed to the Commissioner of Corrections pursuant to 1 V.S.A. § 318(c). The Commissioner of Corrections can be contacted at the following address;
