To Whom It May Concern:

Pursuant to the Vermont Public Records Act, I hereby request the following records:

1) An up-to-date report from the university's Education Advisory Board (EAB) system documenting undergraduate students' predicted risk scores, broken down in aggregate by the following categories:
- Race
- Gender
- Major
- GPA Group
- Race AND Gender
- Race AND Major
- Race AND Gender AND Major
- Race AND GPA group
- Race AND Gender AND GPA group

This data is stored in the university's EAB system as part of the Student Success Collaborative tool and can easily be searched and compiled into reports, as demonstrated by the attached example document provided by the University of Houston in response to a similar public records request for data from its EAB system. Please note that I am not requesting any personally identifying information, but rather aggregate data for the aforementioned groups.

2) All predictive model reports and threshold reports provided to the university by EAB as part of the Student Success Collaborative product.

I ask that all fees be waived as I am a journalist and I intend to use the requested records to publish articles in the public interest and not for any commercial purpose

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter.

I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Mr. Feathers:

In your e-mail message of December 8, you requested “An up-to-date report from the university's Education Advisory Board (EAB) system documenting undergraduate
students' predicted risk scores, broken down in aggregate” by certain specified categories.

I have conducted a diligent search, and the record you have requested does not exist. Vermont law does not oblige the University to generate custom reports or create new records. As required by the Vermont Public Records Act, 1 V.S.A. § 318(a)(4), I certify that the requested record does not exist.

Hello Gary,

Thank you for the response. Could you please explain what you mean by the records not existing? My understanding is that University of Vermont uses the EAB Navigate tool: https://www.uvm.edu/registrar/about-eab-navigate

The records I've requested are available within that tool, which allows users to perform searches and compile reports of existing data, which does not constitute the creation of a new record. I've received this data from other colleges using the EAB Navigate tool without issue.

Dear Todd,

I am writing in response to your email of May 24, 2022 regarding your earlier request for records. I apologize for the delay. The University has transitioned its records custodian duties to me.

The University does not use EAB to produce predictive analysis reports such as the ones requested. As communicated earlier, the records you have requested do not exist. Vermont law does not oblige the University to generate custom reports or create new records. As required by the Vermont Public Records Act, 1 V.S.A. § 318(a)(4), I certify that the requested record does not exist.
