Pursuant to the Vermont Public Records Act, I hereby request the following records:

All documents and transcripts pertaining to UVM student Kendall Ware's interactions with the UV Title IX office. Specifically, I'd like to request all correspondence and transcripts of meetings held with Ware explaining her options and rights to either an informal or formal Title IX investigation.

I’d also like to receive any and all communications relating to Title IX since January 2019 from UVM associate athletic director Krista Balogh’s email krista.balogh@uvm.edu, Title IX coordinator Nick Stanton’s email NStanton@uvm.edu, Title IX investigator Kate Spence’s email Katherine.Spence@uvm.edu, Title IX Coordinator Taryn Moran’s email Taryn.Moran@uvm.edu.

In order to help to determine my status to assess fees, you should know that I am a representative of the news media affiliated with Refinery29 and Vice Media Group, and this request is made as part of news gathering and not for a commercial use.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Ms. Longman,

I am writing in response to your October 13, 2021 request for records. I apologize for the delay. The University has transitioned its records custodian duties to me.

The records requested, which are related to student Kendall Ware's interactions with the UVM Title IX office, and more generally to communications relating to Title IX, are exempt from production under sections 317(c)(11) and 317(c)(7) of the Vermont Public Records Act, which protect student records and personal documents. To the extent that this request would encompass attorney/client privileged documents, they also would be exempt under 317(c)(4). To the extent that this request would encompass deliberative/hearing materials, they also would be exempt under 317(c)(24). To the extent that particular resolution agreements had confidentiality provisions, they also would also be protected by 317(c)(1), designated by law as confidential. To the extent that this request would encompass records of negotiation of resolution agreements, they also would be protected by 317(c)(15).

As provided in 1 V.S.A. § 318(c), of the Vermont Public Records Act, you may appeal to the University's President my determination that the records you have requested are exempt from disclosure.
