Dear Leila,

I am writing regarding your public records request, dated October 2, 2018 and addressed to Adam Silverman, Public Information Officer, Vermont State Police ("VSP"), regarding emails, including attachments, between the VSP and the following four email addresses: jstuckey@adl.org<mailto:jstuckey@adl.org>, taliab@adl.org<mailto:taliab@adl.org>, rtrestan@adl.org<mailto:rtrestan@adl.org>, and ejarvis@adl.org<mailto:ejarvis@adl.org>, from March 1, 2018 to October 1, 2018 (or latest possible date). You specifically requested emails containing in the subject line or body of the message one or more of the following search terms: Israel, NECTS, New England, Counter-Terrorism, Counter, Terrorism, Seminar, Session.

Please be advised that, due to security concerns, the VSP will not confirm or deny travel plans of any employee prior to travel, pursuant to the exemption to the inspection and copying of public records under 1 V.S.A. § 317(c)(25). In accordance with this policy and the statutory exemption, we have no records to release in response to your request at this time.

This exemption is not indefinite, however, and you are free to renew your request at a later date.

If you believe that a record has been withheld in error, you may call me at the number below, or you may appeal this decision. If you choose to file an appeal, we request you do so in writing to:

Commissioner Thomas D. Anderson

Dear Grier,

Other departments have successfully sent me documents in response to my request that do not confirm or deny their employee's travel before it occurs.

These documents have included:

--Invitations to seminars and trainings (without the department's response)
--Programs or agendas

Departments have sent me these documents without providing any information regarding their participation in the programs.

Thank you for your attention to this matter and I look forward to your response.

Sincerely,
Leila

Dear Leila,

I am writing in response to your October 18, 2018 email addressed to me about your earlier October 2, 2018 public records request, addressed to Adam Silverman, Public Information Officer, Vermont State Police ("VSP"), requesting emails, including attachments, between the VSP and the following four email addresses: jstuckey@adl.org<mailto:jstuckey@adl.org>, taliab@adl.org<mailto:taliab@adl.org>, rtrestan@adl.org<mailto:rtrestan@adl.org>, and ejarvis@adl.org<mailto:ejarvis@adl.org>, from March 1, 2018 to October 1, 2018 (or latest possible date). In your October 2, 2018 request you specifically requested emails containing in the subject line or body of the message one or more of the following search terms: Israel, NECTS, New England, Counter-Terrorism, Counter, Terrorism, Seminar, Session.

On October 16, 2018, we responded that we could not release the requested documents to you due to security concerns, because VSP will not confirm or deny travel plans of any employee prior to travel, pursuant to the exemption to the inspection and copying of public records under 1 V.S.A. § 317(c)(25). We also advised you that this exemption to the release of documents is not indefinite, and that you could renew your request at a later date.

In your October 18, 2018 email you requested that we release any invitations, programs or agendas we possess that meet the terms of your original request. We have determined that the two following documents, redacting information exempt under 1 V.S.A. § 317(c)(25), fulfill this request without revealing the travel plans of any VSP employee prior to travel:

1. Invitation, dated June 27, 2018, from Robert O. Trestan and Talia Ben Sasson-Gordis of the Anti-Defamation League

2. Email, dated June 28, 2018, from Talia Ben Sasson-Gordis of the Anti-Defamation League, referencing the invitation described in item 1

We have not located any other records that would fulfill your October 18, 2018 request.

If you believe that I have misinterpreted your October 18, 2018 email, or you believe information in the provided records has been withheld in error, you may call me at the number below, or you may appeal this decision. If you choose to file an appeal, we request you do so in writing to:

Thank you Grier. I understand you cannot confirm or deny future travel of your employees. Therefore I would like to be in touch with your department once the trip in question is over on December 11th, at which point I will ask that my request for any documents and emails related to the trip be completed in full.

Sincerely,
Leila
