Dear Stephan:

In your e-mail message of March 29, you asked for:

"all emails to or from Jane Kolodinsky that contains any of the following terms in any field; 'stonyfield', 'unfi', 'naturespath', 'ccof', 'whitewave', 'wholefoods', 'organicvalley', 'horizondairy', 'mercola', 'Just Label It', 'right to know', 'sorrell' 'vandana', 'navdanya', or 'bronners' from January 1, 2013 to the present."

I enclose a copy of thirty-eight records that meet your description.

I have withheld other e-mail messages that meet your description but are exempt from production under the Vermont Public Records Act:

(1) four records that are exempt under section 317(c)(4), which protects documents that are privileged;

(2) one record that is exempt under section 317(c)(11), which protects student records; and

(3) eleven records that are exempt under section 317(c)(23), which protects research-related records.

Vermont law and University policy allow me to collect costs (see below) associated with record requests. At five cents per page for copying 86 pages, the total cost comes to $4.73 plus 1 hour, 40 minutes labor to respond to the request (first two hours of labor not assessed - see attached invoice).

As set forth in section 318(a), you may appeal to the University's President my determination that some of the records you requested are exempt from disclosure. The President's name is Thomas Sullivan, and his address is 349 Waterman, University of Vermont, Burlington, VT 05405

Sincerely yours,

Gary L. Derr
Vice President for Executive Operations
