Employee listing (Utica Police Department)

To Whom It May Concern:

Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

A listing of every officer and/or employee of the agency, including name, office address, title and salary.

Per NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3)(b):

"Each agency shall maintain:
[....]
(b) a record setting forth the name, public office address, title and salary of every officer or employee of the agency."

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

We have received the attached letter signed by Deputy City Clerk Michelle George and dated February 20, 2015.

The request for the employee listing is not fulfilled by referring to the city budget. The requested document is required to be maintained by the state FOIL statute.

Here is the relevant portion of the statute, for your reference, NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3)(b):

"Each agency shall maintain:
[....]
(b) a record setting forth the name, public office address, title and salary of every officer or employee of the agency."

While the city budget you refer to includes title and salary, it does not include the name or public office address for every officer or employee of the agency.

Also attached is the employee listing provided by the Utica City School District, as an example of the above document as provided in response to a FOIL request.

Hopefully, this clears up any confusion so that the City of Utica is able to complete these FOIL requests in a timely fashion.
