To Whom It May Concern:

Pursuant to the Government Records Access and Management Act, I hereby request the following records:

1) All reports regarding Work Opportunity Tax Credits certified in 2019 and 2020 provided to the US Department of Labor, including forms 9058.
2) Any database tracking Work Opportunity Tax Credit certifications which is created or maintained by your department or by any third party vendor under contract with your department, preferably in .csv or .xlsx format. If it is easier, the database can be limited to the calendar or fiscal years ending in 2018, 2019 and 2020.
3) The most recent of any contracts with third party vendors to track WOTC certifications.

My goal is to ascertain which businesses and industries are applying for and/or receiving Work Opportunity Tax Credits, for which categories of employees and which occupations. If a conversation could help narrow or expedite the completion of this request, I am available at 802 233 4992 and emily_corwin@harvard.edu.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Good morning Emily,

GRAMA section 63G-2-201(3)(b) provides that "a record to which access is
restricted pursuant to . . . federal statute, or federal regulation,
including records for which access is governed or restricted as a condition
of participation in a state or federal program or for receiving state or
federal funds" is not public. Federal law, 26 USC 6103, prohibits state
employees from disclosing any tax return or tax "return information," which
includes a taxpayer's identity, tax credits, and a host of other data
concerning a tax return or with respect to the existence or possible
existence of liability for any tax. The names of businesses receiving the
WOTC and the types of credits they are receiving constitute return
information that is not subject to disclosure.

Further, the state's participation in the WOTC program is conditioned on
compliance with all federal statutes, regulations and policies, including
those of WIOA. WIOA, of course, requires that states have policies in
place to protect PII, records, contracts, sensitive information, etc. The
Grant Agreement expressly requires that the state meet the requirements
outlined in the federal Training and Employment Guidance Letter No.
39-11. The guidance letter requires that PII and "other sensitive
information" obtained under the grant agreement "be protected." Among
other things, this requires the state to "secure transmission of PII and
sensitive data, developed, obtained, or otherwise associated with ETA
funded grants." The letter also provides that states "must not extract
information from data supplied by ETA for any purpose not stated in the
grant agreement." The failure to comply with the letter may result in
termination or suspension of the grant. The requested records are thus not
subject to release under GRAMA.

As requested, form 9058 is attached.
