Mr. Anderson

The statute requires a response within ten business days. Our office works
a 4/10 schedule, which allows for a response by Monday, December 1, 2014.
In addition, this request involves legal analysis and approval before we
can issue a response. In such cases, the statute allows an extension of
five days, which would extend the date until Tuesday December 9, 2014. See
Utah State Code 63G-2-204(5)(f) and (6)(d). In any case, we will provide a
response as soon as possible.

Sincerely,

Josh Bishop

Hello,

Please consider this an appeal to the completion of my Freedom of Information Act request, originally submitted on November 11, 2014.

Specifically, I am appealing the exemptions to the following items from my request:

1. Number and list of non-fusion center agencies authorized to access the SIAC's intelligence databases.

2. Number and list of source agencies who have submitted information SIAC's intelligence databases.

3. Number and list of all public agencies and private contractors providing SAR (suspicious activity reporting) and ISE-SAR information technology or related services to the SIAC.

4. List of external agencies that access the SIAC's intelligence databases or share information with the SIAC.

5. Number of times SIAC personnel, a participating agency, or an authorized user have been found to be in noncompliance with the SIAC policy in regards to the gathering, collection, use, retention, destruction, sharing, classification, or disclosure of information.

6. Number of times SIAC personnel, a contractor, a participating agency, or an authorized user have been suspended, sanctioned, or otherwise disciplined.

7. A copy of all Suspicious Activity Reports that contain any of the following words or phrases: "Animal Liberation Front", "ALF", "Earth Liberation Front", "ELF", "Mercy for Animals" or "PETA".

Items 1 - 4 and item 7 were explained as being exempt from disclosure pursuant to Utah State Code 63G-2-305(10)(a) & (e). (10)(a) states that records are exempt from disclosure if disclosure "reasonably could be expected to interfere with investigations undertaken for enforcement, discipline, licensing, certification, or registration purposes;" while (10)(e) states that records are exempt from disclosure if disclosure "reasonably could be expected to disclose investigative or audit techniques, procedures, policies, or orders not generally known outside of government if disclosure would interfere with enforcement or audit efforts;"

It is difficult to imagine how items 1 - 4, which request merely a list of agencies which provide and/or have access to SAR information, could interfere with law enforcement investigations or could "disclose investigative or audit techniques." As such, I am appealing the response to these items, with a modification to item 3 to the following:

3. Number and list of all public agencies and private contractors providing SAR or related services to the SIAC.

In addition, I would like to modify items 5 and 6 in order to be specific enough to produce responsive documents, as well as item 7.

Therefore, my appeal/modified request is the following:

1. Number and list of non-fusion center agencies authorized to access the SIAC's intelligence databases.

2. Number and list of source agencies who have submitted information SIAC's intelligence databases.

3. Number and list of all public agencies and private contractors providing SAR or related services to the SIAC.

7. The number of Suspicious Activity Reports containing each of the following words or phrases: "Animal Liberation Front", "ALF", "Earth Liberation Front", "ELF", "Mercy for Animals" or "PETA".

Thank you for your anticipated cooperation.

Sincerely,

Evan

From: Evan Anderson

I realize I forgot to modify items 5 and 6. I would like to modify them to the following:

5. Number of times SIAC personnel have violated the SIAC privacy policy.

6. Number of times SIAC personnel have been disciplined.

Sorry about that.

Evan
