Records access considerations The University, as a governmental entity of the State of Utah, is subject to the Government Records Access and Management Act, Utah Code sections 63G-2-101 to -901 (“GRAMA”). The Family Educational Rights and Privacy Act, 20 U.S.C. § 1232g ("FERPA"), also governs the University's legal obligations regarding requests for student information. The University declines to provide any of its directory information in the customized format you have requested. As you may know, government records laws including Utah’s GRAMA provisions attempt to balance two rights: 1) “the public’s right of access to information concerning the conduct of the public’s business;” and 2) “the right of privacy in relation to personal data gathered by governmental entities.”  Utah Code § 63G-2-102(1). Directory information of the University’s students produced in the particular formats you request has little to do with the “conduct of the public’s business” and, therefore, very little do with the right of access to information concerning the conduct of that business. Weighed against this minimal interest is the substantial interest of our students to have personal data gathered by the University protected from wholesale disclosure to persons or entities that might use or sell this information for spam advertising and other commercial purposes. We believe the production of this information in the format you have requested would constitute “a clearly unwarranted invasion of personal privacy.” Utah Code § 63G-2-302(2)(d). In addition, the University is not required to create a record or compile data in response to a request for records. Id. § 63G-2-201(8)(a). The University does not maintain any single document that provides all of the data you seek in your request, which means that the University cannot fulfill your request without creating a record or undertaking substantial compilation, manipulation, and tailoring of information. Consequently, the University declines to produce directory information in the format(s) you request. Appeals To the extent your request is denied, you have the right to appeal this decision pursuant to Utah Code § 63G-2-401(1)(a),(2) & (3).
