Pursuant to the Freedom of Information Act, I hereby request the following records:
All records pertaining to WMATA employees sleeping on the job, including but not limited to internal and external communications, complaints, disciplinary files, messages to staff, meeting minutes, policies, spreadsheets, powerpoint presentations, photos or video, etc. Please do not limit this to cases of employees proven to have slept on the job - the request is intended to also cover alleged, suspected or hypothetical sleeping. If the law requires this request to be limited to a specific timeframe, please produce records from 2011 to the current date. If the law does not require a specific timeframe, please produce all records available. Thank you.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Mr. Carter,
I am in receipt of your Freedom of Information Act request to the Council for records relating to Washington Metropolitan Area Transit Administration ("WMATA") employees sleeping or allegedly sleeping on the job. The Council and DC government has very limited oversight over WMATA and this is the type of issue that would fall outside our jurisdiction. A request for the information you seek is more appropriately directed to WMATA.
Let me know if you have any questions. If I do not hear from you by November 6, 2019, I will follow up with a closeout letter to your request.

Thanks for this info. I have sent a similar request to WMATA but wanted to cast a wide net. Do you think I would be able to get any responsive records back by pursuing this with the Council? If so, I'd like to proceed and see what comes back.
