Vaugh index requested for any material you claim are subject to exemption.

Media requester, request for fees waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Mr. Fernandes,

Our apologies for the delay in the response concerning your fee waiver denial. I would refer you to 43 CFR Part 2.6(d), which says that fee waiver requests must include justification as to how the criteria are met. Although other agencies may have granted a fee waiver for your request, we are not bound to their decision.

Concerning the status of your request, your request is in the queue to be assigned for processing. Please know that we are working to get these records to you as quickly as possible.

Yours,

Tracy Jolivette

Thanks for your response.

It has been my experience agencies that have difficulties in complying with the statutes and timelines for production should seek budget increases to alleviate staffing shortcomings via normal legislative means to secure proper funding.

I strongly do not believe this information requires a complex or lengthy search and it is more a photocopy of information that is sitting in a folder. In my opinion.

Thanks for the status update.

William
