To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

All electronic records in the possession of the following individuals located in the DOE Loan Programs Office:

- John Sneed
- Dong Kwun Kim
- Herbert Glaser
- Robert Marcum
- Douglas Schultz

received from or sent to individuals associated with the following organizations:

- Southern Company (southernco.com)
- Municipal Electric Authority of Georgia (meagpower.com)
- JEA (jea.com)
- Oglethorpe Power Company (opc.com)
- PowerSouth (powersouth.com)

and containing the following keyword:
- Vogtle

As used above, the term “electronic records” includes, without limitation, emails (both sent and received), email attachments, text messages, encrypted messages, and any other electronic records.

The timeframe of this public records request is between January 1, 2018 and the date of this filing.

You may exclude news articles, press clippings, and duplicate emails.

The organization I work for, the Energy and Policy Institute (EPI), is a clearinghouse of information and can qualify as a representative of the news media. There are several examples of public record requests provided to EPI that were published on our website to inform journalists publishing articles. Additionally, federal agencies have previously categorized FOIAs from the Energy and Policy Institute under Title 10, Code of Federal Regulations, Section 1004.9(b)(3) as a "news media" requester and have determined that we satisfy the criteria considered for a waiver of fees.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Daniel Tait

Hey Renee!

Thanks for sending these over. Unfortunately I think I want to proceed with my original request. This was only 8 pages and did not seem to help me narrow down my request.

It was worth the shot!

Good afternoon Mr. Tait,

DOE is continuing to process your request. We have received documents from our search office and are reviewing this information. If this information contains equities identified as belonging to entities external to DOE, those entities may have an opportunity to review their equities during our review process and prior to release to you. Since your request involves a request for information sent to or from DOE employees related to entities outside of DOE, it is possible that the information received will contain such equities and this will extend the time for processing your request to completion.

To expedite processing of your request, would you be willing to waive production of attachments to emails? Upon receipt of your responsive document set, if you have waived attachments, the email will still list the title of any attachments in the email “Attachment” line. At that time, you can review which attachments you want our office to produce. Sometimes attachments can be quite voluminous and significantly increase the amount of time it takes to process a response to you.

If you have any further questions, please contact me via email or phone at the contacts below.

Thank you for the opportunity to assist you in this matter.

Good afternoon Mr. Tait,

Please pardon my delay in responding to you. We are continuing to diligently process your request and review documents responsive to this request. Since your receipt of previously released documents in February 2019, we have searched for documents responsive to your request. Because this request has resulted in voluminous amount of documents with attachments, processing can take a longer amount of time. We will try to have a partial to you within the next few weeks. Thank you for your patience as the process continues.

If you have any other questions regarding this request, please feel free to contact me or the FOIA office.

Thank you for allowing me to assist you in this matter.

Renee,

I've been out of the office all week. I'm looking forward to reviewing records in September.

Daniel

From: Department of Energy

Good afternoon Mr. Tait,

Sorry for the delay in providing a response to this email. We have been working toward a deadline of September. However, many of the documents and attachments determined to be responsive to the request contain equities belonging to entities outside of the DOE, and this has increased the amount of time it is taking to process a final response to you. We are continuing to diligently process your request to provide you with a response as soon as possible.

Thank you for your patience.
