Re: Freedom of Information/Privacy Act Request No. 2015USMS27720
Subject of Request: Privacy Impact Assesments
Dear Requester:
This is in response to your request for “all privacy impact assessments submitted by the USMS regarding its use of devices known as International Mobile Subscriber Identity (IMSI), catchers, including but not limited to the Harris Corporation "Stingray" and the Digital Receiver Technology "dirtbox"; all materials submitted by the USMS as part of the Initial Privacy Assessment process regarding its use of IMSI catchers, as well as the OPCL determination regarding the need for a PIA; and all supporting documentation submitted along with the above PIA(s), particularly the separate application(s) for proposed redactions required to be submitted under the 2012 OPCL PIA guidance.”
Pursuant to your request, the USMS conducted a search of the Office of General Counsel, but located no records responsive to your request.
If you are dissatisfied with my action on this request, you may appeal by writing to the Director, Office of Information Policy, United States Department of Justice, Suite 11050, 1425 New York Avenue, NW, Washington, D.C. 20530-0001. Your appeal must be received within 60 days of the date of this letter. Both the letter and the envelope should be clearly marked “Freedom of Information/ Privacy Act Appeal.” In the event you are dissatisfied with the results of any such appeal, judicial review will thereafter be available to you in the United States District Court for the judicial district in which you reside or have your principal place of business, or in the District of Columbia.
For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA. See 5 U.S.C. § 552(c ) (2006), & Supp. IV (2010). This response is limited to those records that are subject to the requirements of the FOIA. This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist.
Sincerely,
William E. Bordley

To Whom It May Concern:
I hereby appeal the adequacy of the search for FOIA request No. 2015USMS27720, in which I requested:
"-All privacy impact assessments submitted by the USMS regarding its use of devices known as International Mobile Subscriber Identity (IMSI), catchers, including but not limited to the Harris Corporation "Stingray" and the Digital Receiver Technology "dirtbox"
-All materials submitted by the USMS as part of the Initial Privacy Assessment process regarding its use of IMSI catchers, as well as the OPCL determination regarding the need for a PIA
-All supporting documentation submitted along with the above PIA(s), particularly the separate application(s) for proposed redactions required to be submitted under the 2012 OPCL PIA guidance."
Given the Marshals' extensive use of "IMSI catcher" devices and the type of information they collect from cellular phones, it is difficult to believe that no Privacy Impact Assessment was filed in regards to their deployment and use by the Marshals.
As such, I request that you remand this FOIA back for a good faith search for responsive documents.
Sincerely,
William Green
