This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of all nondisclosure agreements signed between the U.S. Marshals Service and state and local law enforcement agencies regarding cell site simulator equipment manufactured by the Harris Corporation.

PLEASE BE CLEAR: this is NOT a request for a search of investigative materials, but for administrative records maintained by the Service regarding restrictions placed on technology developed by the Harris Corporation.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Requester:

The United States Marshals Service (USMS) is responding to your request for “A copy of all nondisclosure agreements signed between the U.S. Marshals Service and state and local law enforcement agencies regarding cell site simulator equipment manufactured by the Harris Corporation.”

Pursuant to your request, the USMS conducted a search of the Technical Operation Group and located no records responsive to your request.

If you are dissatisfied with my action on this request, you may appeal by writing to the Director, Office of Information Policy (OIP), United States Department of Justice, Suite 11050, 1425 New York Avenue, NW, Washington, D.C. 20530-0001. Your appeal must be received by OIP within 60 days of the date of this letter. Both the letter and the envelope should be clearly marked “Freedom of Information/ Privacy Act Appeal.” In the event you are dissatisfied with the results of any such appeal, judicial review will thereafter be available to you in the United States District Court for the judicial district in which you reside or have your principal place of business, or in the District of Columbia.

For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA. See 5 U.S.C. 552(c ) (2006 & Supp. IV (2010)). This response is limited to those records that are subject to the requirements of the FOIA. This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist.
