This is a request under the Freedom of Information Act. I hereby request the following records:

The following materials related to emergency procedures under Contract Number ODT-8-C-0004 (GEO Group):

- Any logs of detainee counts in the possession of the USMS (lines 12-15, C14)
- All notifications of attempted escape (lines 1-2, C16) as well as written reports of the escape or attempted escape and the remedial action (lines 15-18, C20)
- Institution emergency plan, including written agreements with appropriate state and local authorities (lines 4-8, C21)
- The proposed inventory of intervention equipment and any subsequent modifications and written approvals thereof (lines 17-22, C21)

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Requester:

The United States Marshals Service (USMS) is responding to your request information regarding “(1) any logs of detainee counts in the possession of the USMS (lines 12-15, C14); (2) all notifications of attempted escape (lines 1-2, C16) as well as written reports of the escape or attempted escape and the remedial action (lines 15-18, C20); (3) institution emergency plan, including written agreements with appropriate state and local authorities (lines 4-8, C21); and (4) the proposed inventory of intervention equipment and any subsequent modifications and written approvals thereof (lines 17-22, C21).

Pursuant to your request, the USMS conducted a search of the Eastern District of New York and the Prisoner Operations Division and located no records responsive to your request.
If you are dissatisfied with my action on this request, you may appeal by writing to the Director, Office of Information Policy (OIP), United States Department of Justice, Suite 11050, 1425 New York Avenue, NW, Washington, D.C. 20530-0001. Your appeal must be received by OIP within 60 days of the date of this letter. Both the letter and the envelope should be clearly marked “Freedom of Information/ Privacy Act Appeal.” In the event you are dissatisfied with the results of any such appeal, judicial review will thereafter be available to you in the United States District Court for the judicial district in which you reside or have your principal place of business, or in the District of Columbia.

For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA. See 5 U.S.C. 552(c ) (2006 & Supp. IV (2010)). This response is limited to those records that are subject to the requirements of the FOIA. This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist.
