Dear Mr. Suman:
This letter is in initial response to your FOIA request dated September 27, 2020. Your request and document were received by the California Great-Basin regional office on October 8, 2020. The request was assigned the FOIA tracking number DOI-BOR-2020-005926. Please use this number in all future communications regarding the request.
The request is for copies of “USBR Fresno River Cabinet Contents List Binders 3,4, and 5” of the Cabinet Contents List – Fresno River (List). Your requester category is evaluated as ‘other,’ and the request will be placed in the ‘normal’ processing track.
Your request did not completely address processing fees. You did ask to be notified in advance if fees will be required. Including your entitlements as an all other category requester, our estimate is that converting the records from paper to electronic will cost $300. The estimate includes 11 hours of conversion time at the clerical rate of $27 per hour. The cost may be more or less than the estimated fee. If it appears the processing fees are likely to exceed the estimate or the amount you are willing to pay, we will stop processing the request at that point and contact you for further authorization.
You must provide in writing a statement of your willingness to pay all or a portion of the estimated fee before we can accept your request. Pursuant to 43 CFR §2.49, if the bureau does not receive your written response containing the additional information that resolves any fee issues, in accordance with paragraphs (b)(2) and/or (b)(4) of this section, within 20 workdays after the bureau has requested it, the bureau will presume that you are no longer interested in the records and will close the file on the request.

This letter is in final response to your FOIA request dated September 27, 2020.  Your request and document were received by the California Great-Basin regional office on October 8, 2020.  ​This response supplements our previous letter to you dated March 12, 2021.  We received your payment by money order payment on May 24, 2021.  The request is for copies of “USBR Fresno River Cabinet Contents List Binders 3,4, and 5” of the Cabinet Contents List – Fresno River (List).

For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the Freedom of Information Act (FOIA).

See 5 U.S.C. 552(c) (2006 & Supp. IV 2010).  This response is limited to those records that are subject to the requirements of the FOIA.  This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist.

We located 150 records that are considered responsive to your request.  We are providing copies of 149 records with 1,567 pages.  The records, titled Release Portfolio, were uploaded to the FOIA Online website on May 26, 2021.  We were unable to locate copies of two records, 1995_0828 Letter from D. Rathman to J. Turner and 1995_0831 Meeting Notes.  Three records that total six pages have been redacted and one four-page letter has been withheld pursuant to Exemption b(5) of the FOIA.

Exemption 5 of the FOIA allows an agency to withhold inter-agency or intra-agency memorandums or letters which would not be available by law to a party in litigation with the agency.  Exemption 5 therefore incorporates the privileges that protect materials from discovery in litigation, including the deliberative process, attorney work-product, attorney-client, and commercial information privileges.  The excised material is attorney client communications and deliberative comments between an attorney and their client seeking legal advice.  The withheld letter is a letter written and mailed by a Department of the Interior attorney to the Bureau of Reclamation for which legal advice was sought.

The partial denial of this information was made after consultation with Ms. Allison B. Mitchell, Attorney – Advisor, Pacific Southwest Region, Office of the Solicitor, Department of the Interior.  The Reclamation officials responsible for this decision are Ms. Cynthia P. Gaines,
