September 09, 2019 RE:  USAID FOIA No. F-00235-19 (FOIA Specialist Assignment Email) Dear Mr. Freudenthal: This acknowledges receipt of your September 05, 2019, Freedom of Information Act (FOIA) request to the United States Agency for International Development (USAID).  Specifically, you requested the following records:1) All of the emails exchanged between Marc Green and David Malpassand 2) All of the emails exchanged between Marc Green and Annette Dixon(Date Range for Record Search: From 6/1/2018 To 9/5/2019). You also requested a fee waiver. Fee Waiver
The FOIA provides that fees should be waived or reduced if disclosure of the information is in the public interest because it is likely to contribute significantly to public understanding of the operations and activities of the government and is not primarily in the commercial interest of the requester.  As a member of the media, the only applicable fee is duplication.  Duplication is $0.10 per page, but the first 100 pages are free.  After review of the fee waiver criteria, your fee waiver request is moot.  Since the only applicable fee is duplication, and USAID routinely furnishes responsive records to FOIA requesters in electronic format, it's most likely there will be no duplication fees to assess.

To Whom It May Concern:

This is an appeal under the Freedom of Information Act.

On September 5, 2019, I submitted the attached request under the Freedom of Information Act to the United States Agency for International Development. Via a letter dated September 6, 2019, USAID acknowledged receipt of this request and assigned it F-00235-19.

Far more than twenty working days have elapsed without a substantive determination. I am appealing the constructive denial of my request. I ask for a determination requiring that the agency respond to my request, provide the documents, or outline reasons that they are exempt.

Thank you for your time and help with this issue.

Best,

Emmanuel Freudenthal

To whom it may concern:

This is an appeal under the Freedom of Information Act. I question the the validity of the search and ask that it be performed more thoroughly.

The emails that I have requested exist. I have been told by someone close to the matter that they do. USAID and the World Bank have coordinated the Ebola response in Congo at a high level.

There is a strong public interest in the disclosure of the documents because there has been issues with the oversight of funds disbursement for the Ebola response in Congo. There are multiple official investigations into this issue, including by the UN.
