This letter constitutes a request under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, and is submitted on behalf of journalist Alexa O’Brien.

I seek any and all documents in the U.S. Strategic Command’s possession that pertain to the WikiLeaks website or organization from January 2006 to the present date.

I am a “representative of the news media” for fee waiver purposes. See Project on Military Procurement v. Department of the Navy, 710 F. Supp. 362, 363, 365 (D.C.D. 1989). My work has been published in The Cairo Review of Global Affairs, Guardian UK, Salon, and featured by PBS Frontline, On The Media and Public Radio International. Based on my status as a “news media” requester, I am entitled to receive the requested record with only duplication fees asserted. Further, because disclosure of this information will “contribute greatly to the public understanding of the operation or activities of the government,” duplication fees should be waived.

There is a compelling need for the requested documents such that expedited processing is appropriate. I am engaged in disseminating information. There exists an urgent need to inform the public concerning actual or alleged Federal Government activity. As 5 U.S.C. § 552(a)(6)(E)(ii)(I) provides, I will anticipate your determination on our request within ten (10) calendar days.

I requests that in the event that access to any of the requested records is denied pursuant to 5 U.S.C. § 552(b), I be provided with all non-exempt portions which are reasonably segregable. I further request that you describe the deleted material in detail and specify the statutory basis for the denial as well as your reasons for believing that the alleged statutory justification applies in this instance. Please separately state your reasons for not invoking your discretionary powers to release the requested documents. Such statements will be helpful in deciding whether to appeal an adverse determination, and in formulating arguments in case an appeal is taken. I reserve my right to appeal the withholding or deletion of any information and expect that you will list the office and address were such an appeal can be sent.

I requests that documents responsive to this request be provided to me in electronic format on a CD-ROM.

Hi Ms. O'Brien,

I'd like to discuss your request. If you do not wish to by phone, here is what I want to discuss. First off, you have reasonably described the records you seek; however, due to our continuing decline of available resources, a search for "any and all" documents in STRATCOM's possession spanning 7 years will take manpower that we just don't have access to. For me to direct a proper search, the search will have to be conducted by each of our internal 10 directorates, and by each of our 8 geographically separated subordinate commands, which will take many months.

I'd like you to consider narrowing your request, either by better defining the types of documents you seek and/or narrowing the time-frame. Assuming certain types of responsive documents have not met their Joint Staff mandated records disposition schedule and been disposed of, you may receive more useful information by way of requesting "official reports, command guidance, or presentations." If you do not wish to narrow the types of documents you seek, searching thousands of individual email accounts will be next to impossible, will take many months, require manpower that we do not have, and I believe to be unreasonable.

Please don't think I'm trying to skirt around your request, my goal is to provide you the most useful information in a reasonable time that is to your satisfaction and meets your needs.

I'm deferring your request until I hear back from you.

Also, I'm acknowledging your request for expedited processing. You should have our decision once we work out the aforementioned.

My correspondence serves to acknowledge your letter dated December 5, 2013. In that letter you state that I had “reasonably described the records [that I] seek.”

You also stated that you would “like [me] to consider narrowing [my] request, either by better defining the types of documents [I] seek and/or narrowing the time-frame.”

I am willing to narrow my request to USSTRATCOM as follows:

1.) I am seeking all “official reports, command guidance, or presentations" that pertain to the WikiLeaks website or organization from January 2006 to the present date.

2.) I am also seeking all records (official and unofficial) related the court-martial of Pfc. Bradley Manning or the criminal investigation of WikiLeaks by the Departments of Justice or State, NSA, CIA, or other government agencies.

My request includes:

a.) All records pertaining to the communications and documents related to a July 21, 2011 email by military prosecutor CPT Joe Morrow regarding communications with and responsive documents from USSTRATCOM.

I'm still waiting on CYBERCOM to respond to their portion of your request.

I initially tasked our network operations center to conduct a search, I
recently received a response that they no longer have access to the type of
software that would have allowed them to conduct a command-wide search.
This said, the only other way to conduct a search is to task everyone within
the command (3500 plus employees) to conduct searches. The problem with
doing it this way would be the amount of time it would take to conduct
searches. This type of search could take many, many hours.

I'm having a hard time figuring out the best and most cost effective way to
conduct a search.

One possibility would be for me to task our public affairs office and the
command leadership section. The command leadership section might have filed
any Commander-directed memorandums.

Which search direction do you want me to take?

On January 15, 2014 you wrote to me:

After discussing the situation briefly with you on the phone, it was decided that the PAO and command leadership would conduct the search, and if for any reason the search was inadequate, I could always resubmit or appeal.

You also informed me that there were responsive documents from CYBERCOM regarding Mr. Betts classification review of chat logs, but that there was more than one equity for this records(NSA and US Army).

I asked if you could send me an interim response, you said you would do that. So, once I receive that I can wait with you on the responses from NSA and the US Army.

You also let me know that you would let me know how many pages you would refer to NSA and US Army on that matter.

After our last conversation, I tasked our front office and PA to conduct searches, and after a little more thought, I also tasked our internal cyber division to conduct a search. The front office's and PA's search yielded no documents, but our cyber division located 14 or so documents, however, they are telling me that all the documents originated at USCYBERCOM. I should have confirmation today that this is indeed the case. Once I hear back from them, I will then send the documents to USCYBERCOM and direct a review. Since USCYBERCOM is one of our subordinate units, they will send their recommendations to me for further processing.

Is this acceptable?

My apologies for how long it has taken us to get to this point. As is the case throughout the DoD, we are having to doing more with less personnel and decreased funds.

I'll keep you updated.

I am not quite sure how to answer your question, because I am not sure if my answer will prevent me recourse on appeal.

I received OFOI's response on 23 Aug 17 to the consultation request I sent them on 27 Jan 15. It's going through a final review based on Joint Staff's recommendations. I hope to have it to the initial denial authority by the end of the week. Recommending a very limited partial denial.
