A copy of all memos, presentations, legal briefs, PowerPoint slides, or any other document held by or accessible to the USDA which contain any of the following words or phrases: "ecoterrorism," "animal rights," "ELF," "ALF," "AETA," or "animal liberation."

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This correspondence is regarding your attached FOIA request dated February 22, 2015, which was submitted to the USDA FOIA Office. The USDA FOIA Office subsequently forwarded your request to our agency, the Animal and Plant Health Inspection Service (APHIS) to search for responsive records.

According to the USDA FOIA Regulations 7 CFR Part 1 section 1.5(c) a FOIA request must reasonably describe the records being requested. Your correspondence does not provide sufficient information to conduct a reasonable records search therefore we are requesting that you clarify your request. A late search notice has been forwarded to the program on a number of occasions and they have in turn informed us of their backlog. This is an appeal under the Freedom of Information Act. My request, assigned No. 2015-APHIS-03464-F, was not appropriately addressed, in my view. The materials I requested pertain to guidance for farmers or operators of other agricultural facilities on how to respond to trespassers, activists, and people taking footage of the facilities. The person(s) handling my request forwarded it to the Animal Care program office, which is only tangentially related to the matter of my request. A more appropriate agency to forward my request to would be the Risk Management Agency, for example. Please remand this request back to the USDA for a good faith review under the Freedom of Information Act.

Thank you for your reply. If what you are currently seeking is that your request to be forwarded to the Risk Management Agency, that can be done outside of filing an appeal. As was previously stated, we’ve checked with our Administrators office and they have no record or receiving your appeal. As a matter of process, all appeal request are logged in, date stamped and forwarded appropriately. Please advise if you’d like for your FOIA request to be forwarded to the Risk Management Agency.
