Please provide records sufficient to determine the number of voluntary employee union recognitions resulting from a card-check process in the year 2020.

If available, please provide records about individual recognitions with such fields as employer, location, description of bargaining unit, union, size of unit, and number of cards.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Your FOIA request, submitted to the National Labor Relations Board (NLRB) on June 6, 2021, specifically seeks "...the number of voluntary employee union recognitions resulting from a card-check process in the year 2020...". The voluntary recognition process isn't specifically a "card check" recognition. The Agency is notified of voluntary recognition cases by Form NLRB-5581. This form contains language at the top that states "The Employer in this matter has determined that the Labor Organization named below represents a majority of its employees and is recognizing the Labor Organization as the exclusive representative of the employees for the purposes of collective bargaining pursuant to Section 9 of the National Labor Relations Act." The NLRB is not informed of how the Employer makes that majority determination.

The Agency has Voluntary Recognition (VR) data for cases filed in 2020, but the data does not include any information on card checks because it's not information we are provided with. Are you still interested in the VR data that we have, or are you specifically interested in what your request states: card check data (which we don't have)? If you do want the VR data we have, would you like to amend your request to the following: "Please provide records sufficient to determine the number of voluntary employee union recognitions in the year 2020. If available, please provide records about individual recognitions with such fields as employer, location, description of bargaining unit, union, and size of unit."
