UAV cease and desist letters - Oct 2014

To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of any letters, e-mails, or other written or electronic communications requesting or demanding individuals and organizations cease and desist, stop operating, or stop advertising unmanned aerial vehicles, also known as drones.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Hello,

I would like to confirm that your office did not simply provide me with responsive documents sent for FOIA request 2013-3475, submitted by Michael Morisy on March 20, 2013 and completed by the FAA in February 2014.

In response to that request, the FAA sent the attached cover letter in February 2014 — as with the letter sent in response to the present request, a total of 34 pages and 17 communications were sent in response to that request. (These documents can also be viewed online at: https://www.muckrock.com/foi/united-states-of-america-10/unmanned-aerial-vehicle-cease-desist-letters-4768/). By my review, documents sent in response to 2013-3475 are identical to the ones sent for the present request.

I also note that the responsive documents sent to me for the present request do not include any documents more recent than July 2013, by my review.

To be clear, this is a separate request from 2013-3475 — while the communications sent on November 4 are responsive, I suspect that they are not comprehensive, particularly for responsive documents from July 2013 to the date this request was processed.

Please advise as to the processing of this request right away.

There have been at least two commercial entities that have reportedly received cease and desist orders from the FAA since summer 2013 — I have submitted separate FOIA requests for communications between these companies and the FAA regarding commercial use of unmanned vehicles:

I would note that neither of the above FOIA requests has been completed, despite having been submitted more than 6 months ago.

In light of these two reports that seemingly contradict the finding of no responsive documents for this request, I respectfully request an additional search for responsive documents be conducted, or else substantive clarification provided.
