Hello Mr. Musgrave, we are working your request for “data supplied by the Department of Defense of "unmanned aerial systems mishap data." As I think we’ve mentioned previously, we have an enormous backlog of requests. Your request is currently being researched. First, I’m trying to confirm that we still have access to this information. Once this is confirmed, and since this information was supplied to us by the Department of Defense, we must inform DOD that we have received a FOIA request to release this information and give them time to respond. I hope to have an answer to you by September, 30, 2015. We have started releasing incident/accident information online and this information can be accessed at http://www.faa.gov/news/updates/?newsId=83544. Thanks for being patient.

Mr. Musgrave. The records that we were able to retrieve that we feel are responsive to your request had to be sent to DoD for final review. We should be hearing from DoD soon. Once we receive DoD concurrence, we will continue processing your request.

Shari -

Thank you for the update. Is this data required to be reported to the FAA? If so, it's unclear to me why the request was transferred to another agency. Could you provide further information as to why this request is now being transferred nearly three years after its submission?

Respectfully,
Shawn

From: FAA

Hi Shawn. No, I’ve found nothing stating we were required to report out this info. What I found was that DoD shared the information with us, but didn’t “officially” release it to us. I shared all the information with DoD, but FAA isn’t comfortable with releasing it since we aren’t the “owner of these records”. Shari

Hi Shawn. This request was transferred over to DoD to respond to. DoD never provided the FAA approval to release this information. We were only provided an informational copy. DoD still has ownership of the information. Please reach out to the DoD for further information on this request.

Ms. Miller -

Thank you for following up. As I requested in my November 2013 FOIA to the FAA, I seek the following records:

Data supplied by the Department of Defense of "unmanned aerial systems mishap data."

This transfer of data is indicated on page 11 of the January 2013 report, "Department of Defense Report to Congress on Addressing Challenges for Unmanned Aircraft Systems": http://www.defenseinnovationmarketplace.mil/resources/2012AnnualTF-Report.pdf

That report indicated that following: "DoD provided the FAA with 6 years of UAS mishap data, allowing the FAA to have a better understanding ofUAS safety considerations to support increased NAS access decisions."

I thus seek this 6 years of UAS mishap data.

Please advise if you need additional information.

Best,
Shawn
