I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

As you may know, the FEC is an independent regulatory agency that administers and enforces the Federal Election Campaign Act (FECA), as amended, which governs the financing of federal elections. See 52 U.S.C. § 30106. FECA broadly requires the public disclosure of funds raised and spent to influence federal elections. See 52 U.S.C. § 30104.
Responsive, non-exempt records regarding funds raised and spent by the committees you identified and responsive to Parts 1 and 2 of your request are already publicly available on the agency website. You can access these documents at https://www.fec.gov/data/.
To the extent Part 3 of your request seeks records concerning enforcement matters that remain open, such records would be exempt from disclosure under FOIA Exemption 3(A) pursuant to section 30109(a)(12)(A) of the Federal Election Campaign Act and we can neither confirm nor deny that such records may or may not exist. See 5 U.S.C. § 552(b)(3)(A); 52 U.S.C. § 30109(a)(12)(A).
We are continuing to process Part 4 of your request and will provide responsive non-exempt records if and when they become available. We will send you a final response letter and, if there are responsive non-exempt records they will be attached to that letter and we will provide you with a list of all FOIA exemptions that have been applied to any released records and to any responsive records withheld in their entirety, as well as approximate page counts for any documents withheld pursuant to each FOIA exemption.
Accordingly, your FOIA request is granted in part and denied in part. If you need additional assistance locating information on the FEC’s website, please contact the FEC’s Public Records Office.
