To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

Copies of all regular reports between 9/15/2012 and the date this requested is processed made by the person responsible for the DHS priority "threat of radicalization and extremism."

Regular reports would be typical weekly, monthly, quarterly, or as needed updates on the status of the operation made by the director or head of the "threat of radicalization and extremism" DHS priority. The reports may be for their direct supervisor, a board, congress, committees, etc. I provide this additional information and examples to help define what "regular report" means.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Jason Smathers

This is a response, made on behalf of the Intelligence and Analysis Freedom of Information Act Officer, to your request for "[c]opies of all regular reports between 9/15/2012 and the date this requested [sic] is processed made by the person responsible for the DHS priority "threat of radicalization and extremism." Your request has been assigned number 13-OIA-00116.

Please be advised that we are unable to process your request as drafted. Although the primary mission of the Department of Homeland Security is to prevent terrorist attacks and, in the process, to address the threats of radicalization and extremism, among others, one person is not responsible for this effort and there are no identifiable "regular reports on the status of the operation" made by the "head" of this "priority." Without further clarification from you as to what you are seeking, therefore, we are unable to conduct a search for records.

If you construe this action to be a denial of access, you are entitled to submit an administrative appeal to: Associate General Counsel (General Law), U.S. Department of Homeland Security, Washington, D.C. 20528, following the procedures outlined in the DHS regulations at 6 C.F.R. § 5.9. Your envelope and letter should be marked “FOIA Appeal.” Copies of the FOIA and DHS regulations are available at www.dhs.gov/foia<http://www.dhs.gov/foia>.

From: Jason Smathers

You may limit the records to those created by, or in the possession of any of the following positions:
UNDER SECRETARY / CHIEF INTELLIGENCE OFFICER
CHIEF OF STAFF
PRINCIPAL DEPUTY UNDER SECRETARY
DEPUTY CHIEF OF STAFF

You can further limit the records to those created while dealing in whole or part with the DHS priority "threat of radicalization and extremism."

Further, I affirm my initial timeline for these records, so you may limit the records to those created between 9/15/2012 and the date this request is processed.

Finally, to clarify the meaning of "regular reports" - it is commonplace for employees to be required to keep their superiors, boards, committees, congress, or other authorities abreast of their activities. These are the reports which I am seeking when I request "regular reports."
