This is a request under the Freedom of Information Act. I hereby request the following records:

- The most recent "snapshot" or backup of the website at https://www.blm.gov, its subpages and subdomains. This request includes any and all site assets, including but not limited to: website page content; images; audio and video files; downloadable files, such as PDF, CSV, XLSX, and JSON files; databases; datasets; and any and all other site assets. In the event that a recent "snapshot" or backup is not available, then I request a copy of the site itself as of the date your office processes this request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Hello Mr. Eaton,

Our FOIA office received your FOIA request, dated May 15, 2017, which was
received on May 16, 2017. We have assigned it control number 2017-00609.
Please cite this number in any future communications with our office
regarding your request.

In your request you asked for the following:

"The most recent "snapshot" or backup of the website at https://www.blm.gov,
its subpages and subdomains. This request includes any and all site assets,
including but not limited to: website page content; images; audio and video
files; downloadable files, such as PDF, CSV, XLSX, and JSON files;
databases; datasets; and any and all other site assets. In the event that a
recent "snapshot" or backup is not available, then I request a copy of the
site itself as of the date your office processes this request."

We have classified you as an “other” requester. As such, we may charge you
for some of our search and duplication costs, but we will not charge you
for our review costs; you are also entitled to up to 2 hours of search time
and 100 pages of photocopies (or an equivalent volume) for free. See 43
C.F.R. § 2.39. If, after taking into consideration your fee category
entitlements, our processing costs are less than $50.00, we will not bill
you because the cost of collection would be greater than the fee collected.
See 43 C.F.R. § 2.49(a)(1).

We use Multitrack Processing to process FOIA requests. The Simple track is
for requests that can be processed in one to five workdays. The
Normal track is for requests that can be processed in six to twenty
workdays. The Complex track is for requests that can be processed in
twenty-one to sixty workdays. The Exceptional/Voluminous track is for
requests requiring more than sixty workdays for processing. The
Expedited track is for requests that have been granted expedited
processing. Within each track, requests are usually processed on a
first-in, first-out basis.

This request falls into the Normal track. Even though we normally process
requests on a first-in, first-out basis, because of the nature of your
request and the circumstances surrounding this request, we will prioritize
and process your request as the records become available.

I am writing to appeal the integrity of the Bureau of Land Management's ("BLM") search for records in response to my FOIA request, control number 2017-00609.

On May 15, 2017, I sent a FOIA request to the BLM for "The most recent 'snapshot' or backup of the website at https://www.blm.gov, its subpages and subdomains. This request includes any and all site assets, including but not limited to: website page content; images; audio and video files; downloadable files, such as PDF, CSV, XLSX, and JSON files; databases; datasets; and any and all other site assets. In the event that a recent "snapshot" or backup is not available, then I request a copy of the site itself as of the date your office processes this request."

BLM acknowledged receipt of my request on May 18, 2017, and assigned it control number 2017-00609.

On August 10, 2017, BLM contacted me to inform me that "Due to the nature of your request, your FOIA will now have to be updated to reflect the complexity of the request. The track path will change from Normal to Exceptional/Voluminous."

On June 13, 2018, BLM contacted me after multiple follow-up messages inquiring about the status of my request to inform me that it was still searching for responsive records and "will update you once I start receiving records."

On May 16, 2019, BLM informed me that it could not find any records responsive to my request. The idea that BLM does on maintain backups or "snapshots" of its website, a common IT best practice, beggars belief. I am appealing the integrity of BLM's search.
