From: Emma Best

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

Copies of all drafted, submitted or received SF-311 forms (https://www.archives.gov/files/isoo/security-forms/sf311.pdf) produced in the year prior to the receipt of this FOIA request. SF-311 forms may also be identified as Agency Security Classification Management Program Data.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the Internet Archive and MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

Additionally, case law states that “proof of the ability to disseminate the released information to a broad cross- section of the public is not required.” Judicial Watch, Inc. v. Dep’t of Justice, 365 F.3d 1108, 1126 (D.C. Cir. 2004); see Carney v. U.S. Dep’t of Justice, 19 F.3d 807, 814-15 (2d Cir. 1994). Further, courts have held that "qualified because it also had “firm” plans to “publish a number of . . . ‘document sets’” concerning United States foreign and national security policy." Under this criteria, as well, I qualify as a member of the news media.

Additionally, courts have held that the news media status "focuses on the nature of the requester, not its request. The provision requires that the request be “made by” a representative of the news media. Id. § 552(a)(4)(A)(ii)(II). A newspaper reporter, for example, is a representative of the news media regardless of how much interest there is in the story for which he or she is requesting information." As such, the details of the request itself are moot for the purposes of determining the appropriate fee category.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Emma Best

Re: Freedom of Information Act Request: NGC18-353
Dear Ms. Best:
This is in response to your Freedom of Information Act (FOIA) request dated June 22, 2018, and received in our office on June 25, 2018. Your request was assigned FOIAOnline tracking number NARA-NGC-2018-000663, as well as the above internal tracking number. In your request, you stated that you were seeking “Copies of all drafted, submitted or received SF-311 forms produced in the year prior to the receipt of the FOIA request.”
We conducted a search and were able to locate the National Archives and Records Administration’s (NARA) 2017 SF 311 form. We are releasing the five page document in full with no redactions. This document is being provided in PDF format and uploaded to FOIAOnline.
We also located the SF 311 forms provided to NARA from other government agencies. Although NARA was provided the forms, the information within the forms belong to the government agencies who submitted the forms. Therefore, we are referring these SF 311 forms to the agencies for review. You will receive a direct response from those agencies.
This completes the processing of your FOIA request.
If you are not satisfied with our action on this request, you have the right to file an administrative appeal within ninety (90) calendar days from the date of this letter via regular U.S. mail or email. By filing an appeal, you preserve your rights under FOIA and give the agency a chance to review and reconsider your request and the agency’s decision. If you submit your appeal in writing, please address it to the Deputy Archivist of the United States (ND), National Archives and Records Administration, 8601 Adelphi Road, College Park, Maryland 20740. Both the letter and the envelope should be clearly marked “Freedom of Information Act Appeal.” If you submit your appeal by e-mail please send it to FOIA@nara.gov, also addressed to the Deputy Archivist of the United States. Please be sure to explain why you believe this response does not meet the requirements of the FOIA. All correspondence should reference your case tracking number NGC18-353 and your FOIAOnline tracking number.
If you would like to discuss our response before filing an appeal to attempt to resolve your dispute without going through the appeals process, you may contact our FOIA Public Liaison Gary M. Stern for assistance at the address below:

From: Emma Best

I am appealing the integrity of the search, as the request was explicitly for "drafted, submitted or received" SF-311 forms. NARA receives SF-311s from every other Executive Agency, several of whom have refused to provide them because NARA has custody of the records.

Prima facie, this productive and the description of the original FOIA request does not fulfill the clear, explicit parameters of the original request.

From:

Dear Ms. Best:

The National Archives and Records Administration (NARA) routed your attached Freedom of Information Act (FOIA) request to this office, the USDA Departmental FOIA Office (DFO), for review and response. The DFO received your request for processing on October 16, 2018.

The DFO is under the purview of the Office of the Chief Information Officer (OCIO) and serves as the focal point for USDA's FOIA program. The DFO provides coordination and ensures agency-wide compliance with the FOIA. Additionally, the DFO processes requests and appeals on behalf of the Office of the Secretary and Departmental Administration's (DA) components (previously Departmental Management). For a complete listing of DA's components, please visit http://www.dm.usda.gov/agencies.htm.

The FOIA regulation 5 U.S.C. § 552(a)(6)(A)(i) requires USDA to make a determination in response to a FOIA request within 20 business days from its date of receipt. In unusual circumstances, the Federal agency time limit may be extended by 10 business days as stated in 5 U.S.C. § 552(a)(6)(B). If your request seeks numerous records that will necessitate a wide-ranging search including searches with components and possible consultations with components that have a substantial interest in the determination of this request, USDA will invoke a 10 business day extension for determination of your request. You have the option to narrow the scope of your request to limit the number of potentially responsive records.

Due to the increasing number of FOIA requests received by this office, we may encounter some delay in processing your request. Pursuant to USDA FOIA regulations, Title 7 CFR §1.8(d), the USDA processes FOIA requests according to their order of receipt.

Provisions of the FOIA allow USDA to recover part of the cost of complying with your request. For purposes of fee assessment, you have been categorized as a media requester, pursuant to 7 CFR Appendix A to Subpart A of Part 1 Section (5)(c). For your review and information, a copy of the USDA FOIA Fee Schedule is attached.

You have requested a fee waiver. However, your classification as a media requester renders your fee waiver request moot because the only fees that would apply to you are duplication costs beyond the first 100 pages. Since you requested that your response be delivered electronically, duplication costs are not anticipated.

A search will be conducted for records responsive to your request. If any responsive records are located, they will be reviewed for determination of releasability. Please be assured that a FOIA analyst will respond to your request as expeditiously as possible. We appreciate your patience as we proceed with your request.

Your request has been assigned FOIA Case No. 2019-DA-00426-F. Please refer to this case number in any future correspondence. If you have any questions regarding the processing of this request, please contact Ms. Kathleen Drohan at 202-694-1802, kathleen.drohan@ocio.usda.gov<mailto:kathleen.drohan@ocio.usda.gov>, or USDAFOIA@ocio.usda.gov<mailto:USDAFOIA@ocio.usda.gov>.

For additional information regarding USDA FOIA regulations and process, please refer to the information available on-line at www.dm.usda.gov/foia<http://www.dm.usda.gov/foia>.

The DFO team appreciates the opportunity to assist you.

Thanks,

Kathleen Drohan, on behalf of the DFO team.

*Re: NGC18-353/NARA Appeal No. NGC19-005A*

Dear Ms. Best:

This is to advise you that on October 22, 2018, we received on behalf of
the Deputy Archivist of the United States, your administrative appeal dated
October 15, 2018 that you submitted by U.S. Mail. You are appealing our
response to FOIA request NGC18-353 in which we produced NARA’s SF311 for
2017, and notified you that we had referred all other federal agencies’
SF311 forms for 2017 directly to those agencies for review and response to
you. Your appeal has been assigned tracking number NGC19-004A.

The Deputy Archivist of the United States has the responsibility to
adjudicate such appeals. In an attempt to afford each appellant equal and
impartial treatment, we have adopted a general practice of assigning
appeals in the approximate order of receipt. As stated above, your appeal
has been assigned number NGC19-004A. Please provide this number in any
future correspondence to this office regarding this matter. Please note,
if you provided an e-mail address or another electronic means of
communication with your appeal, this office may respond to you
electronically even if you submitted your appeal via regular U.S. Postal

We will notify you of the decision on your appeal as soon as we can. If

Ms. Best,

The Defense Contract Management Agency (DCMA) Freedom of Information Act (FOIA) office has received a referral from the National Archives and Records Administration (NARA) which may contain responsive documents to your request dated June 25, 2018. DCMA has assigned 19-006 as an administrative control number to your request. Reference this control number should you have any questions or wish to address information of your request.

The minimum requirements of a FOIA request include: a request in writing, detailed description of the records being sought so that a knowledgeable official of the agency can conduct a search with reasonable effort, a statement regarding willingness to pay all fees or those up to a specified amount, and requester contact information.

The Freedom of Information Act (FOIA), 5 U.S.C. § 552, makes almost every record possessed by a federal agency disclosable to the public unless it is specifically exempted from disclosure or excluded from the Act's coverage. While your request may be associated with your current position with the Government, a FOIA request is a made in the requestor's personal capacity. Thus, it is not appropriate to utilize government resources for what is a personal matter, as opposed to official business. Please provide and communicate via a non-.mil email address and provide your postal address to accommodate a proper response to your request, avoiding misuse of government resources.

Please be advised that our agency has a large backlog of FOIA cases at this point, so it may take some extra time to process your requests.

Once this FOIA has been assigned, a FOIA manager in the region will conduct a search for records and advise you once this is completed.

If you have any concerns about your request that have not been addressed by the DCMA FOIA Officer, you may contact the DCMA FOIA Public Liaison, Mr. David Wray, for assistance. The DCMA FOIA Public Liaison is available to assist in reducing delays, increasing transparency; increasing understanding of the status of requests and assists with resolving disputes. To ask a question, express a concern, file a complaint or resolve a dispute, contact the DCMA FOIA Public Liaison either by email (DCMA.FOIA@dcma.mil) or by phone at 804‐734‐0202.

Additionally, the Office of Government Information Services (OGIS) offers mediation services to FOIA requesters. If you wish to discuss the possibility of mediation on a FOIA matter, you may contact OGIS directly at the address, email or phone numbers listed on its Web site. (https://ogis.archives.gov/)

Good Afternoon, Ms. Best:

I have been personally working on your two FOIA Requests. Due to the nature of your requests and the voluminous amount of FOIA Requests from the public in general, I am respectfully requesting an extension of 10 business days to one of your requests, SBA-2019-000041, in order to be able to provide you with an accurate Final Response. The original date for a Final Response was due on November 14, 2018. With the extension, the new date for a Final Response would be due on November 28, 2018. Notwithstanding, it is my intention to provide you with a Final Response by November 20, 2018, along with the second of your requests, SBA-2019-000061.

I apologize for any inconvenience this may cause, as well as I am grateful for your consideration. I assure you we are trying our best to provide an accurate Final Response to your request with the due diligence that characterizes our office. Don't hesitate to contact me if there are any concerns on your behalf.

Respectfully,
