Pursuant to the Freedom of Information Act, I hereby request the following records:

Copies of all drafted, submitted or received SF-311 forms (https://www.archives.gov/files/isoo/security-forms/sf311.pdf) produced in the year prior to the receipt of this FOIA request. SF-311 forms may also be identified as Agency Security Classification Management Program Data.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the Internet Archive and MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

Additionally, case law states that “proof of the ability to disseminate the released information to a broad cross- section of the public is not required.” Judicial Watch, Inc. v. Dep’t of Justice, 365 F.3d 1108, 1126 (D.C. Cir. 2004); see Carney v. U.S. Dep’t of Justice, 19 F.3d 807, 814-15 (2d Cir. 1994). Further, courts have held that "qualified because it also had “firm” plans to “publish a number of . . . ‘document sets’” concerning United States foreign and national security policy." Under this criteria, as well, I qualify as a member of the news media.

Additionally, courts have held that the news media status "focuses on the nature of the requester, not its request. The provision requires that the request be “made by” a representative of the news media. Id. § 552(a)(4)(A)(ii)(II). A newspaper reporter, for example, is a representative of the news media regardless of how much interest there is in the story for which he or she is requesting information." As such, the details of the request itself are moot for the purposes of determining the appropriate fee category.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your Freedom of Information Act (FOIA) request dated June 22, 2018, and received in our office on June 25, 2018. Your request was assigned FOIAOnline tracking number NARA-NGC-2018-000663, as well as the above internal tracking number. In your request, you stated that you were seeking “Copies of all drafted, submitted or received SF-311 forms produced in the year prior to the receipt of the FOIA request.”
We conducted a search and were able to locate the National Archives and Records Administration’s (NARA) 2017 SF 311 form. We are releasing the five page document in full with no redactions. This document is being provided in PDF format and uploaded to FOIAOnline.
We also located the SF 311 forms provided to NARA from other government agencies. Although NARA was provided the forms, the information within the forms belong to the government agencies who submitted the forms. Therefore, we are referring these SF 311 forms to the agencies for review. You will receive a direct response from those agencies.
This completes the processing of your FOIA request.

I am appealing the integrity of the search, as the request was explicitly for "drafted, submitted or received" SF-311 forms. NARA receives SF-311s from every other Executive Agency, several of whom have refused to provide them because NARA has custody of the records.

Prima facie, this productive and the description of the original FOIA request does not fulfill the clear, explicit parameters of the original request.

You have the option to narrow the scope of your request to limit the number of potentially responsive records.

Due to the increasing number of FOIA requests received by this office, we may encounter some delay in processing your request. Pursuant to USDA FOIA regulations, Title 7 CFR §1.8(d), the USDA processes FOIA requests according to their order of receipt.

Provisions of the FOIA allow USDA to recover part of the cost of complying with your request. Good morning ma'am,

On 19 Oct 18, NARA referred to me your subject request with the USSTRATCOM
documents they determined to be responsive.

My apologies for the delay, but this FY has been very busy and I'm now ready
to process your request. I've assigned it tracking number 19-024.

I've reviewed the documents and can process them two different ways.
Contained on the SF 311s are the names and contact information of our
responsible personnel, as such, their names and contact information will be
withheld under FOIA Exemption 6 (privacy). If you'll agree, I can identify
the names and contact information as "non-responsive" and get the documents
to you very quickly. However, if you wish to retain your appeal rights,
I'll have to process them to my FOIA Initial Denial Authority, which will
tack on about 2 weeks to the process.
