This is a request under the Freedom of Information Act. I hereby request the following records:

Service contracts and amendments to service contracts filed with the Commission that involve "bulk cargo, forest products, recycled metal scrap, new assembled motor vehicles, waste paper, or paper waste." as per 46 U.S.C. §40502(b)(2). I made an earlier request that seeks all such service contracts (FMC FOIA number 15-02).

This request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This acknowledges receipt of and responds to your Freedom of Information Act (FOIA) request below filed with the Federal Maritime Commission (Commission), on July 22, 2015. Your request, pursuant to the Commission rules at 46 C.F.R. §503.31-34, seeking service contracts and amendments to service contracts filed with the Commission as specified below has been assigned FMC FOIA number 15-030.

As per 46 U.S.C. §40502(b)(1) service contracts are required to be filed confidentially with the Commission. However, 46 U.S.C. §40502(b)(2) provides an exception to that filing requirement. Contracts regarding bulk cargo, forest products recycled metal scrap, new assembled motor vehicles, waste paper, or paper waste, are not required to be filed with the Commission. Therefore, there are no documents responsive to your request.

If you would like more information regarding this subject, please feel free to contact Mr. Kardian, Director, Office of Service Contracts and Tariffs at 202-523-5856[X] and he should be able to provide you with additional information without the need to submit a FOIA request.

You also mention your earlier FOIA request. Our records reflect that the FMC FOIA number of that request was 15-023 and a response was sent on June 11, 2015.

Administrative appeals should be submitted to the Chairman of the Federal Maritime Commission pursuant to 46 C.F.R. §503.32. Also, the Office of Government Information Services (OGIS) offers mediation services to resolve disputes between FOIA requesters and Federal agencies as a non-exclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation.
