This is a request under the Freedom of Information Act. I hereby request the following records:

All regular reports made by the Senior CI Officer from the U.S. Department of Energy's Office of Intelligence & Counterintelligence made between 1/1/2009 and the date this request is processed.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Mr. Smathers,

The Office of Intelligence and Analysis have received your request. However, you did not specifically identify the records which you are seeking. Records must be described in reasonably sufficient detail to enable government employees who are familiar with the subject area to locate records without placing an unreasonable burden upon the agency. For this reason, §5.3(b) of the DHS regulations, 6 C.F.R. Part 5, require that you describe the records you are seeking with as much information as possible to ensure that our search can locate them with a reasonable amount of effort.

In your request you are seeking "All regular reports made by the Senior CI Officer from the U.S. Department of Homeland Security Office of Intelligence & Analysis". It is unclear whom you are referencing when you state, "CI". Please resubmit your request containing a reasonable description of the records you are seeking. Upon receipt of a perfected request, you will be advised as to the status of your request.

If you deem this advisement an adverse action, you have a right to appeal. Should you wish to do so, you must send your appeal and a copy of this letter, within 60 days of the date of this letter, to: Associate General Counsel (General Law), U.S. Department of Homeland Security, Washington, D.C. 20528, following the procedures outlined in the DHS regulations at 6 C.F.R. § 5.9. Regular reports are just that, reports made at some regular interval such as weekly, monthly, quarterly or yearly reports made by the Senior CI Officer to whomever he or she reports to such as a supervisor, director, board or committee.

Regular reports typically explain the status of one's job. They may justify the employees existence. They explain problems, successes and other status information about their current projects.

Please provide these regular reports.

You may further limit this request to records created on or after 1/20/09. Additionally, at your discretion, you can provide me with an index or catalog of organizations which you hold intel on or reports you have created. You may provide such an index in lieu of the actual records. This will allow me to select the organizations or reports I wish to see rather than attempting to describe the organizations and reports in broad terms. After seeing an index, I will file a new FOIA request for the specific records I wish to see based on that index.
