Pursuant to the Freedom of Information Act, I hereby request the following records:
The charge sheet for Lt. Col. Stuart Scheller, who pleaded guilty to all charges during a special court-martial at Camp Lejeune on Thursday.
I also request expedited processing. The records I am requesting are urgently needed by a member of the press to inform the public about actual or perceived government activity — namely, the full extent of the charges a Marine officer pleaded guilty to in open court. There is extensive public interest in this case. The news value of these records will be lost without expedited processing.
Additionally, the US Navy Judge Advocate General manual states that documents "may generally be released through a cognizant public affairs officer" in "the absence of a protective or other order issued by the presiding military judge," which includes "information that has been admitted into evidence or has otherwise become a part of the public record of a court-martial in open session" or "the result of any stage in the judicial process." The public affairs officer informed me that I would be required to FOIA this document despite a charge sheet being the result of a stage in the judicial process and having been admitted into evidence as part of the public record.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
