This is a request under the Freedom of Information Act (FOIA). On behalf of the Climate Investigations Center (CIC), a national non-profit association of advocates, bloggers and researchers, pursuant to FOIA, I hereby request the following records:

1. Records, documents, and correspondences exchanged between Ron Josephson (josephson.ron@epa.gov) and David Schnare;
2. Records, documents, and correspondences received or sent by Ron Josephson (josephson.ron@epa.gov) related to EPA-G2016-ORD-D1 and the Oil and Gas Development in the Appalachian Basin;
3. Records, documents, and correspondences received or sent by Ron Josephson (josephson.ron@epa.gov) containing the following terms: "climate change"; "carbon"; "greenhouse"; "regulations"; "industry"; "oil and gas development"; and "Appalachian basin".

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. CIC is entitled to a fee waiver because it is a news media organization, and because this request for records concerns activities or operations of the government. Disclosure of the requested records will likely increase public understanding of government operations since CIC has the ability and the intention to effectively convey information contained within the requested records to a broad public audience. Founded in 2014, CIC’s investigative research and reporting has appeared in local and national publications such as the New York Times, the Huffington Post, and the Washington Post. In addition to using the information from this request to generate news stories, CIC would distribute information obtained and inform the public at large through various online platforms (such as http://climateinvestigations.org/).

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This letter concerns the above-referenced Freedom of Information Act (FOIA) request, received by the U.S. Environmental Protection Agency (EPA or Agency) on August 9, 2017, in which you requested:
1. Records, documents, and correspondences exchanged between Ron Josephson and David Schnare;
2. Records documents, and correspondences received or sent by Ron Josephson related to EPA-G2016-ORD-D1 and the Oil and Gas Development in the Appalachian Basin;

The Agency is diligently processing your FOIA request.  However, we have questions with respect to item number 3 of your request. Can you provide a specific time period for the information you seek?  In addition, we request that you narrow the scope of topics requested in item 3.  The list of terms is too broad for us to be able to search for the specific information you seek.
We would like to provide you the opportunity to clarify the records that you are seeking.  This FOIA request is tolled until we receive your clarification or modification.  Please respond to this request for clarification or modification within ten calendar days from the date of this letter.  Once we receive your clarification or modification, we will continue processing your FOIA request.  If we do not receive a response from you within this time period, we will consider your request to be voluntarily withdrawn.

I just received notification that the above-referenced FOIA request was withdrawn by your office today.

I received your request for clarification on Aug. 22, 2017 and responded on Aug. 25, 2017, just three days after receipt of your request. I assume the withdrawal is because your office thinks that I did not respond?

Please advise on how we can move forward and reopen the request.

Hello,

Thank you for contacting the Environmental Protection Agency's National FOIA Office. You contacted us in regards to a FOIA request emailed to the agency in September 2017.
I located the request in our case management system, FOIAonline. An email sent on August 9, 2017 was received by EPA and entered into FOIAonline as tracking number: EPA-HQ-2017-010422. A copy of the FOIA request is attached.
On August 22, 2017, the FOIA Program contacted the requester Mr. Daniel Sherwood to ask for information necessary for processing. The letter was emailed to the requester’s email address on file, which was: requests@muckrock.com<mailto:requests@muckrock.com> The FOIA Program could not proceed without more information, asking for a timely response “Please respond to this request for clarification or modification within ten calendar days from the date of this letter. Once we receive your clarification or modification, we will continue processing your FOIA request. If we do not receive a response from you within this time period, we will consider your request to be voluntarily withdrawn. “A copy of this letter is attached for reference.
