This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of all incident reports that involved rocks being thrown at Customs and Border Protection officers within the last five years.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

FOIA APPEAL

To Whom It May Concern:

After nearly two years of processing, Customs and Border Protection released a one page document in response to my request for "A copy of all incident reports that involved rocks being thrown at Customs and Border Protection officers within the last five years." This request was acknowledged on 07/07/2014, and assigned tracking number CBP-2014-035699.

I appeal the adequacy of the search and the response. My request for "all incident reports" would include copies of any reports that were written down and filed, not just a table of how many total were filed. While there may be some reports of minor incidents that were not written down, it does not make sense that there are no written reports at all.

I request that my request be remanded for an additional search, and all responsive records be released to me subject only to appropriate redactions.
