This is a request under the Freedom of Information Act, for which I am requesting expedited processing.

I hereby request the following records:

The Official Military Personnel File (OMPF) including all Fitness Report and Counseling forms (NAVPERS Form 1610/2), the most recent Cumulative Record Of Training (NAVPERS Form 5300/16), the Background Summary (NAVPERS Form 1640/32), Officer Personnel Action Requests (NAVPERS Form 1301/85) and Form DD-214, for a former Navy sailor named Robert J. O'Neill.

Robert J. O'Neill and his family members have told numerous news outlets that he is the Navy SEAL member who shot and killed Osama bin Laden during a May 2011 raid of bin Laden's compound in Abbottabad, Pakistan.

O'Neill also works as a motivational speaker in the Washington, D.C. area, and has repeatedly stated that he worked as a member of the Navy SEALs:

In order to help locate the requested documents, I am supply the following details of O'Neill's biography:

— He was born in April of 1976 (I do not know which exact day)

— He grew up in Butte, Montana

— He joined the Navy at or around the age of nineteen, which would mean in or after April 1995

— He left the Navy in or around September 2012 (I do not know the exact date)

As noted above, I also request expedited processing of this FOIA request. O'Neill is considered an expert on the activities of the U.S. military, including classified operations carried out by the U.S. Naval Special Warfare Development Group, by the national news media. As stated above, he is also claiming credit for one of the most famous military incidents in recent American history—the death of wanted terrorist Osama bin Laden.

For these reasons there is a compelling, obvious urgency to inform the public about the veracity of O'Neill's claims to alleged government activity, including his service in the U.S. Navy. This should fulfill the requirements of requesting expedited processing from this agency. Please respond with an estimation of the amount of time it will take to process the request.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Mr. Trotter:

Records concerning your FOIA request dated November 6, 2014, regarding
Robert O'Neill have been referred to this office from the Navy Personnel
Command. The records you requested are as follows:

"Fitness Report and Counseling Forms, and the most recent Cumulative Record
of Training, the Background Summary, Officer Personnel Action Requests, and
form DD-214."

This command anticipates our review of those records to be complete by
January 15, 2015. We will than refer the records to USSOCOM FOIA office as
the organization with cognizance over the records, and in this case the
release authority who will make the final release determination.

Unfortunately, this Activity will not be able to provide you a substantive
determination within the 20 working-day time frame established by the FOIA
because of the multiple layers of command that this request will need to be
coordinated through. The processing, search and evaluation of your request
is therefore complex and assigned an anticipated release date the week of
February 1, 2015. Because the date is beyond the 20 working day time limit
of the FOIA, I must inform you of your right to appeal to the Office of the
Judge Advocate General at the following address:
