From: Michael Morisy
To Whom It May Concern:
This is a request under the Freedom of Information Act. I hereby request the following records:
A copy of all responses sent to Congressional committees between Jan.1, 2008 and the date that this request is processed. These communications are stored together and should be easily accessible.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Michael Morisy

Dear Sir:
This is in regard to your inquiry on your FOIA request, ATF Disclosure Division is experiencing a significant demand from the public and oversight entities. This significant demand has caused a backlog of FOIA requests, and is considered an “unusual circumstance.” See 28 U.S.C. § 16.5(c). Because of these unusual circumstances, we need to extend the time limit to respond to your request beyond the ten additional days provided by statute.
Due to this backlog, we estimate that it will take three to four months from the date of this letter to respond to your request. Please note this is only an estimated date of completion as there may be circumstances that lead to a longer or shorter processing time. The time needed to complete our processing of your request will necessarily depend on the complexity of our records search and on the volume and complexity of any records located. In any event, we will follow up with you if we are able to locate potentially responsive documents from the appropriate ATF component. If you wish, you may modify your request so that it may be processed within the time limits.
I regret the necessity of this delay. ATF employs a general practice of processing FOIA requests on a first-come/first-served basis, but I assure you that your request will be processed as soon as possible.
Sincerely,
ATF
Disclosure Division
