This is a request under the Freedom of Information Act. I hereby request the following records:

For all currently ongoing US Air Force Directed Energy Bio-Behavioral Research (DEBR) or any other Directed Energy contracts in the United States of America--as of today's date--using Directed-Energy Weapons (DEWs), Non-Lethal Weapons (NLWs), or any kind of Electronic Warfare or Combat Systems Testing/Training involving the use of radiation weaponry of any kind whatsoever on “human subjects,” whether to determine the “human effects” or “bio-effects” of such radiation, or for any other purpose, please provide:
1) The full USAF contract with each contract-awardee or winning offeror company, and the full Statement of Work included with each contract;
2) Complete Documentation of Informed Consent from all human subjects targeted by this contract's Bio-Behavioral Research or Weapons Testing and Training program, including:
a) The FWA (Federal Wide Assurance) signed off by the Office of Human Research Protections, Department of Health and Human Services;
b) Any additional internal Air Force Assurance document assuring compliance with the Common Rule signed off by the Air Force Institutional Review Board involved;
c) All affirmations of Compliance Oversight from the Office of Human Subject Research Protections; &
d) All Waivers of Consent from the Secretary of Defense, if and as applicable, and full reasons for these waivers;
3) Complete Documentation with precise details on Location and Field of Operation where these Directed-Energy weapons are being trained "wittingly" or "unwittingly," overtly or covertly, on human subjects--namely, American civilians and others in the USA.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am contacting you today in an effort to clarify and, possibly expedite your requests. Request number 2015-01006-F has been kicked back by several offices due to a lack of clarity. The requests is asking about research relating to contracts for directed energy technology however, no contract is cited. In order for any responsive office to be able to provide relevant records, a contract number is required. Records being requested must currently exist and they must be specified with clarity. We are not allowed to compile lists or create records pursuant to a FOIA request. This request is not a legal request because it is asking us to research and compile records pertaining to a subject, not a particular record. I have annotated the request below.

Request number 2015-00532-F, handled by Carmen Oglesby, has a contract number and is currently being worked by the office specified. This also pertains to the same subject being requested in the previously mentioned request with the only addition being a few new offices of record. My proposal is that you withdraw 2015-01006-F and amend 2015-00532-F to include the aspects of both requests. This will allow us to save you time and money. I have included an example of how the amended request could look below.

As a member acting on behalf of a media outlet serving the interests of the public, I request a fee waiver. In the Event that a fee waiver is not granted I am willing to pay up to (pick an amount over $14).

1) USAF contract with General Dynamics Corporation awarded in response to the solicitation BAA-HPW-RHDR-2013-0002, Agency: Department of the Air Force, Office: Air Force Materiel Command, Location: AFRL/RQK - WPAFB;

2) Complete Documentation of Informed Consent from all human subjects targeted by this contract's Bio-Behavioral Research or (lethal & non-lethal) Weapons Testing and Training program, including:

Upon reviewing of the communication sent below it was observed that I did not include a suspense date for a reply. Please respond with your decision concerning FOIA 2015-01006-F within 10 business days (3 June 2015). If no communication is received by this date then your FOIA request 2015-01006-F will be closed due to it not being reasonably described.

FOIA 2015-00532-F is being worked as clearly releasable per your request via email sent on 27 March 2015. I expect this action will be completed soon.

Hello, Jason J Defrain,

Thank you for noting that my request which you reference as FOIA 2015-00532-F will be completed soon, on a clearly releasable basis. I look forward to receiving this information.

I would like to remind your office that my original FOIA request which you referenced as 2015-01006-F was made on 11/20/2014, and the delay in response from the USAF has stretched over 6 months.

I would also like to point out that my request is fairly clearly spelled out. While I have not referenced any contract numbers, I have fully described the kind of contract I am requesting information on. In reviewing other FOIA requests to Federal agencies, I am also certain that my request for information is a perfectly reasonable one, since very often requests are made "for all correspondence" or "all contracts" or "all memoranda" on a specified subject. I am not sure what you mean by suggesting this is not a "legal request" therefore.

I would like also to remind the USAF that the information being requested has to do with the Informed Consent of all human subjects being experimented on by the USAF using Directed-Energy Weapons or Non-Lethal Weapons, within the United States. Obviously this is a very serious matter, and the failure of the USAF to provide adequate documentation of complete informed consent of any and all human subject volunteers in any ongoing DEBR project under contract or under execution would point inevitably to the conclusion that covert human subject experimentation, as many citizens suspect and attest, by the USAF, using potent, Electro Magnetic Radiation and Ultrasonic/Infrasonic Directed-Energy Weapons is currently and has been long underway in the United States.

I do not think it is unreasonable that I would ask for Informed Consent/and Contract text information on ALL Directed Energy Bio Behavioral Research contracts currently ongoing--the USAF, and in particular, the Directed Energy Bio-Effects Division (RHD) of the Air Force Research Laboratory, and the Human Effects Center of Excellence (HECOE) must surely maintain clear record of this information. The HECOE states it is a one-stop shop for all human effects from non-lethal weapons research, see http://jnlwp.defense.gov/Portals/50/Documents/Press_Room/Newsletters/FY08_2nd_Qtr_Newsletter.pdf. The Directed Energy Directorate of the Air Force Research Laboratory states it is the Air Force's center of expertise for directed energy and optical technologies, see http://www.kirtland.af.mil/afrl_de/.

The kind of contract information on which I am looking for is similar to this contract, awarded to Veridian in 2002: http://www.monitorclipper.com/index.php/mcp-news/313-veridian-awarded-five-year-air-force-contract-to-conduct-bio-effects-research-and-development.

It is very much in the interests of the American public that this request is being made. I must therefore reiterate my request as is and suggest that central USAF groups which are responsible for Human Subject Research and Experimentation using Non Lethal and Directed Energy Radiation Weapons, such as the HECOE and the AFRL, in particular, be requested for a response.

Please note also that I have requested a fee waiver on both requests as a media requestee of information to be made freely available to the public. Should there be any fees involved, kindly let me know.
