This is a request under the Freedom of Information Act. I hereby request the following records:

Please provide the full USAF contract with General Dynamics Corporation awarded in response to the solicitation BAA-HPW-RHDR-2013-0002, Agency: Department of the Air Force, Office: Air Force Materiel Command, Location: AFRL/RQK - WPAFB; as well as all documentation of informed consent from human subjects targeted by this contract's Directed Energy Bio-Behavioral Research Non-Lethal Weapons testing program, such as the FWA (Federal Wide Assurance) signed off by the Institutional Review Board involved, all affirmations of Compliance Oversight from the Office of Human Subject Research Protections, and all Waivers of Consent from the Secretary of Defense, if and as applicable, and reasons for these waivers, as well as precise details on location and field of operation where these Directed-Energy weapons are being trained "wittingly" or "unwittingly" on human subjects--namely, American civilians and others in the USA.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sirs, the status of the FOIA in question is as follows:

The records requested are located in two separate offices/organizations at Wright-Patterson AFB. One set of records has been released to our legal office for final review and we anticipate they will be released soon barring any corrective action must be taken prior to release. The other set of records has been returned by the FOIA Office to the office of primary responsibility (OPR) for corrections, review, and signatures. As those are completed, it appears they will also be released to our legal office for final review.

Contact has been made with Muckrock News on three occasions since receipt in this office; 5 Nov 14, accepting the FOIA in our office and two interim responses sent 18 Nov and 23 Dec 14. We neglected to tell you in our acceptance memorandum however the waiver was approved based on the media status of the requester and there will be no charge assessed for the responsive records. We will review our memoranda to ensure information relative to informing the requester of the current status is thoroughly explained in our outgoing correspondence. Further, as the records are reviewed and finalized, we will provide release of the responsive records.

If we can be of further assistance, Ms. Caddell does in fact still work with us in the WPAFB FOIA RSC; this office is separate from AFMC FOIA RSC. Ms. Caddell can be reached at 937-522-3091 or 937-522-3095.

We received your 10 November Freedom of Information Act (FOIA) request for the
following records: For all currently ongoing US Air Force Directed Energy
Bio-Behavioral Research (DEBR) or any other Directed Energy contracts in the
United States of America--as of today's date--using Directed-Energy Weapons
(DEWs), Non-Lethal Weapons (NLWs), or any kind of Electronic Warfare or Combat
Systems Testing/Training involving the use of radiation weaponry of any kind
whatsoever on "human subjects,"

The FOIA Control number assigned to your request is 2015-01006-F.
Processing target date is 20 Feb 15

FOIA Office needs clarification in two items:
(1)Please tell the FOIA Office if you will accept CLEARLY RELEASABLE
records.

In a CLEARLY RELEASABLE Response:
-You will not get an official denial letter from the Initial Denial
Authority (Thus, taking less time).
-Responsive Records will be redacted of all data that the submitter
(contractor) reasonably wants redacted.
-Responsive Records will be redacted of all personal names.
-Responsive Record redactions will have no FOIA Exemption code.
-You will not have appeal rights; however, you may submit a new request for
ALL the records not agreeing to CLEARLY RELEASABLE responsive records.
Normally, this speeds the process up substantially.

(2)Please tell us if you require the 2-page DD FORM 254, DoD Contract
Security Classification Specification (attached). Normally, requester's do
not require this form and it slows the FOIA processing down substantially
because it contains info that may harm agency operations and physical safety
of DoD Employees.

Please respond to and answer the two (2) questions above.

1) I would like to accept CLEARLY RELEASABLE responsive records, but I would ALSO like to request all other records, in which respect I would like to know if I should submit a separate (repetition of my original) request or if this note should suffice, please let me know.

2) I am not clear on the import of the form you mention--2-page DD FORM 254, DoD Contract Security Classification Specification--and its relation to my request, and would very much appreciate your clarification on this. Just as above therefore, and especially if this form has bearing on my request, I would like to ask whether this form can be included later along with the non-clearly-releasable records that will subsequently be released on further separate request, as you suggest to my query above.

We received your e-mail dated 18 June and 21 May stating your understanding that you were to receive "clearly releasable" documents. That desire did not make it into our notification. Instead, our records through e-FOIA indicated you did not want "clearly releasable" records. Therefore, your request was processed through normal channels and the Initial Denial Authority (IDA) reviewed the responsive documents and made a formal release determination. The reasons for the redactions appear on the documents being provided. In addition to the documents regarding the contract, there will be another portion of releasable materials sent to you as soon as final action is taken. Should you disagree with the responsiveness in either portion of

your request, your appeal rights are detailed in your letter from our IDA.

The responsive records will be mailed to you on 22 June.
