This is a request under the Freedom of Information Act. I hereby request the following records:

Please send detailed information on the number of Somalis that have been deported to Somalia since 2010, including the reason for deportation when possible.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

RE: FREEDOM OF INFORMATION ACT APPEAL

This letter constitutes an appeal under the Freedom of Information Act ("FOIA"), 5 U.S.C. § 552, and is submitted to the Immigration and Customs Enforcement ("ICE") by Jay Gairson via the public blogging and news service MuckRock.com.

On November 19, 2012, Jay Gairson via MuckRock.com ("Requester") requested documents via MuckRock.com's submission service as set forth in MuckRock's request service. ICE has never responded to the request, despite follow-ups via MuckRock.com on December 19, 2012, January 18, 2013, February 17, 2013, April 4, 2013, and May 15, 2013. Furthermore, ICE has not made any determination regarding the Requester's FOIA request. Through the date of this appeal, ICE has failed to make any determination regarding the Requester's FOIA request.

The proper component of ICE is bound to decide a request for normal FOIA processing within twenty working days. 5 USC § 552(a)(6)(A)(i). As of the date of this letter, ICE has not communicated any determination or receipt of request regarding the Requester's FOIA request. This failure can be construed as a constructive denial. 5 USC § 552(a)(6)(A). The Requester hereby appeals ICE's failure to make a timely determination regarding the Requester's FOIA request. Wash. Post v. Dep't of Homeland Sec., 459 F. Supp. 2d 61 (D.D.C. 2006) (citing Payne Enterprises v. U.S., 837 F.2d 486, 494 (D.C.C. 1998).

The Requester's request relates to records of deportation of Somalians since 2010 by ICE. The Requester believes it is in the public interest to know how many Somalians are regularly removed from the United States and for what reasons, because of the dangers inherent in returning individuals to a country that is held hostage by terrorists, civil war, and famine. Furthermore, since the Requester intends to publish the results of this FOIA publicly all fees should be waived.

Thank you for your prompt response to this appeal. As the FOIA provides, I anticipate that you will produce responsive documents within 20 working days. If you have any questions, please feel free to contact me by responding to this request.
