Pursuant to the Freedom of Information Act, I hereby request the following records:

All FAA records mentioning or pertaining to the Commercial Space Transportation License for Sea Launch, which is assigned the license number LLO 02-066 by the Office of Commercial Space Transportation.

This includes the original application for this license; all subsequent revisions submitted by members of the corporate consortia that have held this license; all required disclosures, such as proofs of insurance and reports of the Sea Launch Environmental Monitoring and Protection Plan; all submissions pursuant to launches by the licensee; all safety inspection data; and all findings and reports related to accident or near-miss reporting in the Aviation Safety Reporting System.

If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the FAA has no other copies of said records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

To whom it may concern:

This is in response to the emails of Lina Garcia and Brian Rushforth regarding the above-captioned FOIA request.

I am more than happy to hear from the FAA on its concerns regarding the scope of the request. However, I must insist that this communication format (email) is best for the deliberate process of dealing with those concerns. Please state them in writing. I will listen.

I hope that this clarifies issues, and look forward to the agency's response.

Dear Sir or Madam:

There are several issues.

First, what you are requesting is a very, very large search. All records pertaining to Sea Launch, it’s license, safety inspections, etc. is potentially thousands of dollars in search and review. To the extent we can narrow down “all records mentioning or pertaining to” on this licensee, that would help.

Secondly, many of the records are physical, and again the search and duplication required will be substantial. In addition, our offices are currently closed to non-essential personnel due to COVID-19.

On the environmental documents, many of those were formally publicly available, so we are moving those to FAA FOIA Library. When they are online, we can let you know. There is no charge for those.

Finally, we would be unable to find responsive records in the Aviation Safety Reporting System, a system run by NASA. ASRS records are voluntary reported and de-identified before they arrive to FAA systems.

If you do not wish to modify the scope, we will conduct a full estimate of the cost of the search for your review and approval.

I have found that when working with the public, media, and others on scope issues, it’s a lot easier to have conversation about it, and then follow up with an email for the record. If you would like to do that, I’m happy to talk.
