Pursuant to the Freedom of Information Act, I hereby request the following records:

All Bureau records mentioning or pertaining to the late Richard Louis Brodsky, a Member of the New York State Assembly serving from calendar years 1983 to 2010. An attached news story shall serve as proof of Brodsky having passed away in 2020; as such, there are no longer privacy exemptions under FOIA or under the Privacy Act.

To assist in the identification of records, the first five digits of Brodsky's Social Security Number are 134-36; his date of birth as listed on Wikipedia is May 4, 1946; his date of death listed on the same is April 8, 2020. His longtime residence was in Westchester County, NY.

Please conduct a search of the Central Records System including (but not limited to) the Counterdrug Information Indices System (CIIS), ELSUR Records System, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, and the Technical Surveillance (TESUR) Indices, for both main-file records and cross-reference records for all relevant names, individuals, agencies and companies.

If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the Bureau has no other copies of said records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

On 4/8/2020 I made a request for records concerning Richard Brodsky. I have not received either a formal acknowledgement nor an assigned number, so I have no means by which to check my request on the FBI Vault website.

I am therefore forced to APPEAL on grounds of the Bureau's constructive denial in not acknowledging the request within a more-than-generous time period.
