From: John Dyer
To Whom It May Concern:
This is a request under the Freedom of Information Act. I hereby request the following records:
I request any and all records and investigations produced by the OIG relating to fatal and non-fatal shootings by the United States Border Patrol agents in the United States and Mexico border from 2008 through 2014. Please include any information and reports relating to how many firearms were discharged in the US-Mexico border by Border Patrol agents and in how many cases was it a warranted use of force. As well, please include any and all information on where and how many civilians were a)wounded by firearm discharge from a Border Patrol agent b)shot dead from a firearm discharge from a Border Patrol agent.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Mr. Dyer,
I would like to discuss this request with you and see if you are willing to receive a narrative listing of responsive cases. This is a list of data that is pulled from our investigative database. It typically contains the following fields:
Case number
Date opened
Date closed
Type (investigation, complaint, etc)
Action
Status
Disposition
Allegation
Narrative of the incoming complaint.
In the event you wish to request more information about any of the cases on the list, you may notify us in writing of the specific information you are looking for.
Please advise if you agree to this handling of your request.
Sincerely,
Kirsten Teal

Mrs. Teal: proceed with the narrative listing of responsive cases. It's ok by me.
Thank you

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on March 12, 2014. Please let me know when I can expect to receive a response, or if further clarification is needed. You had assigned it reference number #2014-084.
Thank you for your help.

Mr. Dyer,
We have a previous FOIA request which asked for all "use of force incidents" by CBP from 2005 to the date of the search for that request, which was run in January 2014. Would you be willing to receive this spreadsheet on an interim basis, and then we can run an updated search from that January date to present? It would be for all of CBP, not just the border stations.
We currently have a large backlog of these types of requests. This would cut down on our response time significantly. It would also reduce or eliminate most fees, since this spreadsheet has already been processed. Otherwise, we will need to run a new data pull, and reprocess the spreadsheet.
Thank you
Kirsten Teal
