Pursuant to the Freedom of Information Act, I hereby request the following records:
The agency's records related to Zeresenay Ermias Testfatsion, 34, who died while being deported to Eritrea after spending over a year in ICE Detention facilities. His A Number is A212-903-961.
Mr. Testfatsion is deceased and thus exemption (b)(6) does not apply. Proof of his death is here, a copy of which is attached:

Mr. Testfatsion had been in ICE custody since Feb. 2, 2017, following his arrest at a United States port of entry while attempting to apply for asylum in the United States. In October 2017, a federal immigration judge ordered Testfatsion removed from the U.S.
Mr. Testfatsion has filed several habeas petitions while ICE moved him around the United States. His A Number is contained in his habeas petitions. We cannot get a waiver from him, because he is deceased. However, no privacy waiver is required, because he is deceased.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
