This is a request under the Freedom of Information Act. I hereby request the following records:

Printout/listing of documents in the National Security Agency's ADMS document management database that are more than 80 years old (i.e. that have a date before 1933).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Mr. Morisy,

This email is to follow-up on the phone conversation you had with the NSA FOIA
office on 7 Jan 2013, regarding the FOIA request you submitted on 26 December 2012.

We are currently processing a similar FOIA request that asks for documents
found in our ADMS system with dates between 1900 and 1929. If your request
can be narrowed to this date range, your request can be processed along with
this case. This will help with the response time as there are a number of cases
ahead of yours in our processing queue. Any/all documents located must be
reviewed to determine releasability and responsive documents for that
request will be included in yours.

If you also want documents dated between 1929 and 1933, an additional search
will be required and can be conducted.

Please be advised that any documents found will not be NSA originated since
this Agency was not established until 1952. The results may be very convoluted
and some of the documents may likely belong to the military organizations which
were the predecessor agencies to NSA.

We are holding your request, pending a response from you. Please advise how
you like to proceed with this request. If we do not hear back from you within
5 calendar days, we will assume that you are no longer interested in this case
and we will administratively close it.

Morning Mr. Morisy,

In response to your inquiry, I wanted to be sure that your received our letter mailed to you on or about 23 Jan 2013. The letter explained that your FOIA req #69484 is being processed in conjunction with another case as the responsive documents cover the same topic. Unfortunately both cases are on the backlog, which is significant. We do separate cases into volume and complexity criteria so that easier cases are not held up needlessly by extremely difficult cases. However, it can still be a lengthy process.

Please be advised that all FOIA requests are processed on a first-in first-out basis and also go through two levels of review. We appreciate your patience as we work our FOIA backlog in accordance with established regulations.

I have checked again on the status of your request and found that it is still in our backlog queue waiting to be assigned to a reviewer. As a reminder, your case will be processed along with another FOIA Case 65200, which contains the document responsive to your request. Case 65200 is also still pending assignment to a firs reviewer. Please be advised that all cases go through at least two levels of review prior to release determination.

The NSA/CSS frequently receives referrals and consultations from other agencies that often pre-date the cases in our review queue. Other agencies, with similar backlogs, may have a case for a year or more before determining that they need to consult or refer their case to the NSA. When this happens, Department of Justice mandate requires this Agency to place a referral/consultation ahead of others. Therefore our backlog queue has a tendency to fluctuate over time with regard to where each FOIA case stands. This is also why it is difficult to provide an estimated response date as it could change.
We appreciate your patience as we work our FOIA cases in the order in which they were received, in accordance with established regulations.

Mr. Morisy,

The case is still in one of our complex backlog queues, pending assignment to an a second level reviewer. Please be advised that each case must go through two levels of review before a release determination can be made. Given the volume of our backlog and the fluctuation of queue placement due to consults from other agencies that predate your request, it's likely that your case may not be assigned to an approval authority within the next 12 months. At this time, the estimated completion date is approximately three 2-3 years.
