Good afternoon,

On the 21st of July I received a response to my request stating that I submitted a request through a method that isn’t authorized by the EPA. The response stated that the new regulation became effective on July 26, 2019. I would like to respectfully note that my request was confirmed as submitted on June 4, 2018. This means that my request was submitted through an authorized manner by the date of submission. Also, even under the new regulation it still qualifies as an authorized submission as it was submitted through the online portal. Therefore, I would like for my request to be placed in the position that it was originally at based upon the date of submission. Thank you.

To Whom It May Concern,

On June 1, 2018 I submitted a FOIA request that was acknowledged on June 4, 2018. On July 21, 2020 I received an email stating that the manner in which I sent the request was not authorized by EPA FOIA regulations. In the email it states that there were updates to the EPA regulations more than one year after I submitted my request. I sent an email at the beginning of the month and I still haven't heard back. Because of the lack of response, I have decided to appeal my request. May the administrative record show that I submitted this request before the EPA FOIA regulations were updated through an authorized manner. Also, the request was confirmed as being received through the online portal that was authorized under EPA FOIA regulations. I also hereby appeal this request as the amount of time of a non-response has passed the statutory requirement of 20 days and an extension has not been requested. Thank you.
