Re: FEC Freedom of Information Act Request, No. 2016-121
Dear Mr. Jones:
This email concerns your Freedom of Information Act (FOIA) request to the Federal Election Commission (FEC), which was received in our office on September 23, 2016. Specifically, you requested any and all documents mentioning "Pepe the Frog" from March 2016 to present. You also requested that a search be conducted for the following terms: (1) "rare pepe"; (2) "spurdo"; and (3) "meme magic."
In accordance with 5 U.S.C. § 552(a)(6)(B)(i) and 11 C.F.R. § 4.7(d), we are extending the processing period due to "unusual circumstances" as described by the FOIA and FEC regulations. This extension is necessary under both the second and third prongs of the FOIA's definition of "unusual circumstances." Pursuant to the second prong of the FOIA's definition of unusual circumstances - 5 U.S.C. § 552(a)(6)(B)(iii)(II) - your request requires an examination of a large quantity of separate and distinct potentially responsive records. 11 C.F.R. § 4.7(c)(2). Additionally, pursuant to the third prong of the FOIA's definition of unusual circumstances - 5 U.S.C. § 552(a)(6)(B)(iii)(III) - your request requires consultation with two or more components of the Commission which have a substantial subject matter interest in the request. 11 C.F.R. § 4.7(c)(3).
Because your request cannot be processed within the time limit specified in the FOIA, this letter provides you an opportunity to limit the scope of the request so that it may be processed more expeditiously or to arrange an alternative time frame for processing the request or a modified request. We expect a determination with a complete response to your FOIA request by November 7, 2016. If, because of the voluminous nature of your request, it becomes necessary to produce documents to you on a rolling basis, you will be promptly notified during the initial document production.
Due to the nature of your request and the FEC's response, you may contact our FOIA Public Liaison, Kate Higginbothom, at (202) 694-1650 for any further assistance and to discuss any aspect of your request. Additionally, you may contact the Office of Government Information Services (OGIS) at the National Archives and Records Administration to inquire about the FOIA mediation services they offer. The contact information for OGIS is as follows: Office of Government Information Services, National Archives and Records Administration, 8601 Adelphi Road-OGIS, College Park, Maryland 20740-6001, e-mail at ogis@nara.gov; telephone at 202-741-5770; toll free at 1-877-684-6448; or facsimile at 202-741-5769. Please include the following tracking number in all future correspondence regarding this matter - FOIA Request 2016-121.
If you have any questions about this letter, you may contact the FOIA Requester Service Center at (202) 694-1650 or by email at FOIA@fec.gov.
Sincerely,
Peter K. Han
