To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

Each Privacy and Civil Liberties Oversight Group (PCLOB) compliance report, including all annexes and addenda, for all years available, including the February 2016 report. Recommendations made by PCLOB to the DoJ, FBI, DHS, DNI, or any other U.S. Government agency also requested. Mandatory declassification review will be requested for withheld materials, thus, careful attention to actual sensitivity of responsive materials is requested. Please do not rely on existing outdated prior classification assessments when determining material responsive to this request. Thank you!

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM, DVD-R, or BD-R if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Martin Peck

Mr. Peck:

Thank you for your email. As explained in the PCLOB's acknowledgement letter, potentially responsive documents to your request are in the consultation process with other federal government agencies. This means that other agencies are reviewing documents. You are welcome to narrow the scope of your request in an effort to speed up the process. I am happy to work with you to narrow your request. Please just let me know if this is something you would like to do.

My estimate - and this is only an estimate - is that I may be able to process your request in the next 2-3 weeks, on or about May 19, 2017. Of course, if anything can be released before then, I will send it along to you.

Please know that we regret the delay and are doing everything we can to move the consultation process along in a timely manner.

Please do not hesitate to contact me if you have additional questions.

Thank you,

Mason Clutter

Mr. Peck:

Your request is still in the consultation process. Unfortunately, once the information is in the consultation process, I have very little control over the processing time because the request is then placed in the other agency's queue of consultation requests. But please know that I am on top of this and checking in frequently with the other agencies. In the meantime, you may access the PCLOB's publicly available information here: https://www.pclob.gov/library.html. Please let me know if you find what you are seeking on our website. If so, we can close out your request.

Please do not hesitate to contact me with other questions or concerns.

Thank you,

Mr. Peck:

Thank you for checking on the status of your request. As I have explained, your request remains in the consultation process with other executive branch agencies. Those agencies do not have an estimated completion date, but they are working on processing our consultation request.

Have you reviewed the Board's website yet to determine if what you are seeking is already available online? The Board's publicly available reports are available here: https://www.pclob.gov/library.

Please take a look at what we have posted online and let me know if what you are seeking is already posted on our website. If so, we can close out your request. Otherwise, we must wait for the other agencies to process the consultation request.

Thank you,

Thank you Mason for your update!

Unfortunately the website is of no use for obtaining the annexes and addenda which are partially or fully omitted for the years in question. I would also still appreciate declassification review for the materials withheld under previous outdated classification guidelines.

I will wait patiently for the consultation to complete.

Best regards,
Martin Peck

Mr. Peck,

Thank you for your response. I am unclear what you are referring to when you say "the annexes and addenda which are partially or fully omitted for the years in question." To what reports are you referring? I think it may be helpful to chat about this over the phone so that I can be absolutely clear about what you are seeking. I am free before noon today. May I give you call? What is your phone number, please?

Thank you,
Mason
