Good Afternoon Mr. Fernandez,
This is in response to your attached Freedom of Information Act (FOIA) request for any photography in our records of al-Jalaa tower located on the Gaza Strip. Specifically you are seeking records created and stored prior to May 15, 2021.
I wanted to reach out to you so that you might provide some clarification about what exactly you are requesting. A search of the World Wide Web reveals numerous photos of the tower taken prior to the date you specify in your request. Is there something specific you are looking for such as a specific angle or detail in regard to the tower? Are you seeking overhead/satellite images?
We appreciate you taking time to provide this clarification which will allow us to provide the most responsive of information. We ask that you provide your response by June 11, 2021. If we have not heard from you by this date, your request will be administratively closed. You may of course resubmit your request at any time.

Notice of appeal:
Agency has failed to respond to my explanation to the FOIA person to 'dumb it down' or simplify the search. Agency has attempted to obstruct records in response asking the requester to seek information on the World Wide Web. The Agency pursuant to FOIA and widespread media attention in relation to the destruction of the building has overwhelming public interest in sharing any and all photographic records in its possession in relation to it.

Hi there:
I received an acknowledgement email, but I thought the the initial request was pretty precise. So I was wondering what was going on. Since the date of the request the building has been featured in many news stories including a feature by the Guardian and a few others.
Please let me know what you would like me to clarify?

Good afternoon,
Based on the attached Freedom of Information Division (FOID) initial final
determination, FOID explains that the FOIA request received was misdirected,
and that NGA, and or DIA would be the organizations most likely to have
purview over the information which you have requested.
With the above response, would you wish to withdraw your FOIA Appeal for
case 21-A-1096-A1, in reference to FOIA request 21-F-1096? Please note the
mailing addresses to NGA, and DIA FOIA Offices as provided by FOID. Or are
you now appealing the FOID initial determination.
Thank-you in advance for your response.
Respectfully,
Don,

No, I would not like to withdraw the appeal. I was specifically seeking any records in your custody. Which could include any briefing notes etc provided in relation to the planned destruction of the property that could include visuals, schematics, etc. The response does not indicate a search was completed.
From: Department of Defense, Office of the Secretary of Defense
Good morning sir,
Thanks for your response. We understand that you are appealing the Freedom of Information Division (FOID) response to your request which was for:
"Pursuant to the Freedom of Information Act, I hereby request the following records:
I was seeking any photography in your records of al-Jalaa tower located on the Gaza Strip.
I was seeking records created and stored prior to: May 15, 2021 (you may limit the prior time
frame to be reasonable)
And any records created and stored after May 15, 2021
The building has been in the news recently due to an international crisis related to failures in
diplomatic relations, and encouragements for retaliatory strikes."
In your email response below, you indicate you also are requesting : "I was specifically seeking any records in your custody. Which could include any briefing notes etc provided in relation to the planned destruction of the property that could include visuals, schematics, etc."
Pleases note that the above request was not included in the initial FOIA request, and would now constitute what would be consider to be new FOIA Request. Should you wish to request "briefing notes etc. provided in relation to the planned destruction of the property that could include visuals, schematics, etc.," you are advised to submit a new FOIA request for that information to the FOID.
Currently, we processing your FOIA appeal based on the FOID response as it relates to your initial FOIA Request, and its original search terms.
