RE: FOIA request #2018-00099-FOIA-OS (copy attached, for ease of reference)
Good afternoon, Mr. King. This e-mail is in reference to your FOIA request, dated June 15, 2017, in which you requested the following records, as stated: all data on the distribution and use of oral contraceptives, including the type and location, since Jan. 1, 2000. You also requested that the data be segregable and in an Excel document.
First of all, we apologize for, and sincerely regret, any delays that have occurred in processing your FOIA request. The Department of Health and Human Services (HHS) receives a large number of FOIA requests, and unfortunately, like many large agencies, we have a backlog which we are working to address. We remain very committed to providing responses to FOIA requests and remedying the FOIA request backlog.
While I was reviewing your FOIA request and doing some background research, I found several reports on the subject of contraceptive use, which you may find generally informative, should you not have seen these reports before (attached). I believe it is possible that the National Center for Research Statistics at the Centers for Disease Control (CDC) may maintain some of the information you requested. It is also possible that the Office of Women's Health and the Office of Population Affairs could potentially maintain responsive records to your request. The Office of Women's Health and the Office of Population Affairs are part of the Office of the Assistant Secretary for Health (OASH).
We are sending your request to both the CDC FOIA Office and the Public Health Service (PHS) FOIA Office for search, and to provide a direct reply to you. To explain, the PHS FOIA office handles FOIA requests for OASH records, hence the referral. The contact information for both those offices is below. What customarily occurs in the case of a referral and transfer of a FOIA request is that the receiving FOIA office will send you an acknowledgment letter or e-mail, and provide you with a new case tracking number for your FOIA request.
