This is a request under the Freedom of Information Act. I hereby request the following records:

A list, catalog, or index of all reports issued in 2011 which contain the numbering system "IA-0000-11". 11 is the year of the report and 0000 is the number of the report which is updated sequentially. At a minimum, the responsive record should include the name or subject of the report and the report number.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Because this email has gone unanswered. I hereby appeal the final response which did not include the responsive records being sought.

My initial request was for: "A list, catalog, or index of all reports issued in 2011 which contain the numbering system "IA-0000-11". 11 is the year of the report and 0000 is the number of the report which is updated sequentially. At a minimum, the responsive record should include the name or subject of the report and the report number."

What you provided was a list of FOIA requests and their tracking numbers, which is not responsive to this request.

Please consider my initial request and the clarification later provided and quoted and provide the responsive records.

FOIA APPEAL

Dear Appeals Authority,

This is an appeal under the Freedom of Information Act. On September 30, 2011 I made a FOIA request to the Department of Homeland Security, Office of Intelligence and Analysis. I requested the following records:

A list, catalog, or index of all reports issued in 2011 which contain the numbering system "IA-0000-11". 11 is the year of the report and 0000 is the number of the report which is updated sequentially. At a minimum, the responsive record should include the name or subject of the report and the report number.

On October 7, 2011, Tony Tucker responded by providing me a log of FOIA requests made to their office.

On October 28, 2011 I responded to Mr. Tucker explaining that the FOIA log was not responsive to my request and that I was in fact looking for a different record. In my October 28, 2011 response, I provided the following explanation:
“The record you provided is not what I was looking for. You provided an index of FOIA requests, however, I am looking for an index of reports issued by OIA. For example, see this OIA report: http://www.fas.org/irp/eprint/rightwing.pdf The above report is numbered IA-0257-09. It is an ‘assessment’ and is titled "(U//FOUO) Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment" This example report is one of many that OIA publishes. These reports are given a number such as IA-0257-09 in this case. My request is for an index of these reports where the report number ends in -11, indicating it was created in fiscal year 2011.”

Mr. Tucker did not respond to my October 28, 2011 correspondence. So, I sent a follow up request for a status update on November 29, 2011. Mr. Tucker responded that same day with a duplicate copy of the first response.

On November 30, 2011, I sent an appeal to Mr. Tucker where I included my prior communication and stated the following: “Because this email has gone unanswered. I hereby appeal the final response which did not include the responsive records being sought. My initial request was for: ‘A list, catalog, or index of all reports issued in 2011 which contain the numbering system ‘IA-0000-11’. 11 is the year of the report and 0000 is the number of the report which is updated sequentially. At a minimum, the responsive record should include the name or subject of the report and the report number. What you provided was a list of FOIA requests and their tracking numbers, which is not responsive to this request. Please consider my initial request and the clarification later provided and quoted and provide the responsive records.”

I have received no communication from the Office of Intelligence and Analysis since this time. I requested status updates on the following dates, but received no reply:

On Nov. 30, 2011:

I appeal the exclusion of responsive records. On October 28, 2011 I sent an email that went unanswered trying to explain the problem. The contents of that email follow:

The record you provided is not what I was looking for. You provided an index of FOIA requests, however, I am looking for an index of reports issued by OIA.

The above report is numbered IA-0257-09. It is an "assessment" and is titled "(U//FOUO) Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment"

This example report is one of many that OIA publishes. These reports are given a number such as IA-0257-09 in this case. My request is for an index of these reports where the report number ends in -11, indicating it was created in fiscal year 2011.

Because this email has gone unanswered. I hereby appeal the final response which did not include the responsive records being sought.

My initial request was for: "A list, catalog, or index of all reports issued in 2011 which contain the numbering system "IA-0000-11". 11 is the year of the report and 0000 is the number of the report which is updated sequentially. At a minimum, the responsive record should include the name or subject of the report and the report number."

What you provided was a list of FOIA requests and their tracking numbers, which is not responsive to this request.

Please consider my initial request and the clarification later provided and quoted and provide the responsive records.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest.
