This is a request under the Freedom of Information Act. I hereby request the following records:

A log, index, directory, printout, or other listing of reports created by the office of Intelligence and Analysis.

For example, I have a pending FOIA request for report IA-0117-11 which was submitted to the Office of Intelligence and Analysis and referred to Customs and Border Patrol (see 12-OIA-112).

Since generation and distribution of these reports is a systematic activity of the Office of Intelligence and Analysis, it is reasonable to expect that these reports are indexed or summarized in another report. I am seeking a listing that contains at minimum a description or title of the report and the report number.

I have submitted a request via FOIA for this information in the past. That request was denied, then after speaking to the FOIA liaison (William Holzerland at the time), the request was accepted, and finally I was sent a copy of the FOIA log and the request was closed. I objected that I did not request a copy of the FOIA log, rather, I request a log of reports created as I described in this request. However, I never heard back to my objections and I submitted an appeal to tony.tucker@hq.dhs.gov on November 29, 2011. Despite many follow up requests for a status update, I have not received any communication since that date. That earlier request was only for reports created in 2011. See 11-OIA-0056 for this earlier FOIA request. If you look at this earlier request and compare my initial request with the record provided, you should plainly see that the record provided is not responsive to my request. I still consider 11-OIA-0056 open and pending.

This is a new request for all records created between January 20, 2009 and the date this request is processed.

This request is for noncommercial use. I, Jason Smathers, am requesting this information directly by using an email account provided to me from MuckRock.com. Just as you do not consider other requests coming from email accounts where the user must pay for the email service as commercial, you should not consider this request as commercial. I am a user of muckrock.com, not an owner, nor do I have any other financial interest in MuckRock. The responsive records will be posted on MuckRock.com as a public service, but there is no possible profit available to me for doing this.

I request billing as a "all other" requester. I will be reviewing the records for possible reporting of news. However, I have no definite plan to write about these records. Therefore, I am not requesting news media billing for this request, I am however requesting the "other" fee category. I am willing to pay statutory fees up to $25. If fees are expected to exceed this amount, please let me know before continuing to process the request so I can consider either reducing the scope of the request or expanding my willingness to pay fees.

I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
